There is NO WAY at least in a non-corrupt legal system like Australia's that any alleged crime can be taken to court without satisfying BOTH the mens rea principle and the actus reus principal! And whilst we are on the subject of the law I might add Lamboo ji that quoting ur second section...attempt to murder is what SID would be charged with as he had disengaged the pistol! TAPU would be charged with CONSPIRACY to commit murder...which would be much more difficult to prove considering that tapu can use many defences here...and her sentence would be greatly reduced...max to about 3 years!
