Compulsory order concerning the custody and parentage of the child before the surrogacy procedure as per the Surrogacy Regulation Act, 2021
A legal document is Compulsory irrespective of the relationship between the surrogate and biological parents. *READ THE BOLD and blue PARTSection 4 (clause-III) sub-clause (II) an order concerning the parentage and custody of the child to be born through surrogacy, has been passed by a court of the Magistrate of the first class or above on an application made by the intending couple or the intending woman and the surrogate mother, which shall be the birth affidavit after the surrogate child is born.

Well that have been shown in so many fictional shows. Indian laws are for real citizens. For Fiction, you can only file a complaint with MIB, IBF, BCCC.
If they find that it defies rules set by the concerning agency, then the track is changed.
