Nice thread, I am a writer, but I get stuck all the time so I wouldn't mind some help and I wouldn't mind helping others who need help also.

May be this will inspire me to finish my pending SS, my only pending story so far and I want to finish it but I am lacking motivation.😭

Seems intriguing!

Legal, because the original creator/author [person who owns the copyright] gives permission or sells the right to the movie to the person making the remake.

It's the same with book adaptations for movies. Chetan Bhagat had given his nod for the makers of 3 Idiots to be partly inspired from his work; later, he made a ruckus when the film was to be released.😆

Lots of creative works fall into the public domain after a number of years. [Public domain = someone can lawfully be inspired to create derivative works (which fanfiction is); to own the copyright to your work, you must substantially add original content to what has been your 'inspiration'.]

I'm not familiar with Indian law [this differs from country to country]. Roughly, books fall in the public domain after 70 years of death of the author and movies, 50 years after its release.

With regards to fan fiction and plagiarism, there's the case of Twilight and Fifty Shades of Grey. FSoG was originally published as a Twilight fan fiction, later the author changed the characters' name, added a few additional scenes and published it as new fiction. The characters are heavily inspired from Twilight and even the style of writing in both books is similar. Stephanie Meyer, the original author hasn't brought a legal action against FSoG author, though she has huge chances of winning this case.
