I guess it depends on the country you come from. Usually in a marriage only one person holds the issma (rites )and decides weather or not to divorce and its usually the husband unless it's stated otherwise on the marriage contract. Khulaa where I come from is a type of law protecting a woman's rite to separate from an unwilling husband . Usually the husband doesn't want to divorce out of spite leaving the wife hanging.Thats when the wife who doesn't hold the marriage rites or control of the marriage wants out and the husband doesn't agree the wife claims khulaa which is basically taking her husband to court presenting a valid reason in front of a judge as to why she wants out ( example the husband is abusive, or cannot have children just to name a couple )and a judge determines the divorce or not taking the decision out of the husbands hands.
