Child marriage is illegal, but is not null and void automatically. Creatives already clarified it in Jagya-Anandi case. Perhaps this is also because of society.

Jagya and Anandi's marriage was not null and void immediately because no one told law they are married Their marriage came into law 's notice when they both were at legal age of marriage and according to law when Balak Var and Balika Vadhu reaches the legal age of marriage and after that till a specific period they don't wish to cancel their child marriage their marriage is given legal tag Thats how JaAn marriage became legal if it would be reported immediately when they were under age then their marriage would be cancelled and Singhs and Khajan would be sitting in jail

As for Ganga she was assaulted when she was a kid At that time her marriage was illegal but when she grew up unaware of law she didn't report thats why applying same rule her marriage forcefully became legal but what Rat did with her when she was a kid by no means in my view he can escape even under society 's tag he did that with her can escape he was her husband ?

Ganga's marriage to Rat also became legal just like the way J and A's marriage became legal once That's why I said Rat escaped the punishment because nobody reported him when the he got married to Ganga while she was still a child.

He would have been booked for rape as well as child marriage if some reported him at that time.

All over the world including the west, the moral standards for a woman was different and more stringent for a woman. If you read the novels based on even19'th century like the ones by Sommerset Maugum, in one one of them, an extremely loving husband's attitude changed drastically the minute

He knew that his wife was raped in the past even though he knew it was not her fault. He says,

I kniw it is not your fault but i can not live with you. West has come a long long way from there.

I would attribute it to advancement in general and affluence where every family has access to this advancement in thinking. In India unfortunately this advancement has not reached the general mass

Mainly due to lack of financial empowerment.

A section of society has refused to follow law of the land as far as child marriage is concerned (even now a large number of child marriages are performed in some States of India on auspicious dates such as Akshaya tritiya), perhaps for this reason, the child marriages are not declared null and void automatically - instead - The law makes child marriages voidable by giving choice to the children in the marriage to seek annulment of marriage.

If the child marriage act is strictly followed, all the marriages (except the exceptions like Shyam-Sugna, Asha-Avinash) of Jaitsar were illegal - what will be the consequence of such a scenario? Perhaps to avoid a large number of marriages in some parts of the country being illegal, the provisions of optional annulment of marriage and limitations like No Court can take cognizance of any offence under this Act after the expiry of one year from the date on which the offence is alleged, may have been made.

The fact is - Anandi, Jagya, Ganga and perhaps people like Rat, DS, Basant etc. were ignorant of the fact of Child marriage being illegal. People of Bilaria knew this fact because of teacherjee, still they refused to follow law (this include all people of Bilaria and not only Anandi's parents).These marriages are the norm in those part of land. @bold- unfortunately, the law of land is equal for all, it cannot be changed because it happened with Ganga or anybody else. It is not even about the child being married to a grown up man because as 'Nirbhaya' has told - if he wants to, a juvenile can be more brutal than a grown up man.

@bold 1 mmm DS was not ignorant child marriage is illegal😛 From Sandhya's arguments she knew it though none among Singhs knew it becomes legal too at some point

Sanchi can get sympathies from law because she is a rape victim on other side a woman who has faced physical assault from childhood Just because she was that man's balika vadhu ignorant of law became his legal wife so her case is dismissed from law as thats not rape What kind of equal law is this ?Law should take action against any kind of this act equally then it will be equal law Now it is not if going by your argument

I don't think Basant shud be put in the same category as Saurabh.

Sure - Basant exercised force on an unwilling wife and he shud not have and Gehna suffered marital rape till she conceived. But here - Gehna's own parents too - did not think what she was undergoing was rape.

DS and Gehna's parents and Bhairon and Sumi - all thought it was wifely duty and Gehna had no business denying her husband. They all were shown to feel that it was unfortunate that she seemed to feel so horrified about a natural part of a marital relationship.

Basant thought - I need a child. She is my wife. I wish she would like me but if she doesn't, I can't just give up my own need for a child.

Basant was shown as a guy who tried a lot to keep his young wife happy. He got the music master for her - remember ?

He wanted his wife's happiness. Except he wanted a child more - but he was never an animal like Ratan or Saurabh.

Basant was not right - but at that time - he was also not exposed to the thought that unwillingness of a partner is rape. Also - he was not an animal like Ratan who was carnal and brutal and delighted in solely hitting and abusing his wife.

Ratan was the lowest of scum. What Ganga endured was pure horror and it was for years on end which is why she ran away.

Saurabh is worse than a modern Ratan.

He thinks bcoz he's a guy and bcoz he has connections - he can get away with anything. He can hold an MMS over the petrified victim's head and get away scot-free. He doesn't even bother to marry a girl and excuse his behaviour by saying the wife needs to provide sex willy nilly. NO - he just drugs and gets his way and shuts their mouths with a threat of exposing their own shame.

Saurabh is a danger to society. He deserves to be hanged.

Atleast Ratan thought he was just exercising his conjugal rights. Ratan wasn't a zamindar who was picking up any random village girl and pillaging her. He was beastly to his own wife but no one else.

Saurabh is the criminal here.

Basant cannot be stood in the same category as Saurabh. And I think CV's handled Gehna Basant track very well. They very clearly showed that Gehna understood Basant only needed a child from her and also wanted her to be happy and not resent him. And once Gehna was expecting - she saw the huge change in Basant and how he used to try to keep her happy. Gehna forgave and accepted Basant and has grown to love him and later chose to have another child with him after going to great lengths to get it.

Sanchi - as horrible and mean and selfish as she was - never deserved to get drugged and raped and mocked by the MMS. Nobody - not even a Sanchi - deserves to be date-raped and made to feel ashamed with the video.

Saurabh deserves not just jail for a rape, he also deserves to be held for cheating, loss of trust, blackmail and threats, mental torture and I don't know what all he can be held accountable for.

Saurabh and his types need to be punished severely and made examples of - and his friends - specially that witch Ankita shud get to see why it is bad and not cool to drug and rape people just to settle scores or just bring them down a peg. Saurabh and Ankita deserve severe punishments.

Will Ankita ever get punished ? She's a girl and knows the full extent of what happened and still is watching the whole thing like a tamasha ? How low can a person get ? She's like a pimp.

Though I agree on your take...and sanchi didnt deserved to be rape...she should have known better...she and her damn ego clouded the responsebility she had toward herself and her safety...
