I believe there is a lot of very clear cut legal paper work involved which basically allots a sum of money to the woman at different stages of her pregnancy and a final sum at birth. After that - the birth giver is free of the child and can lay no claims or change her mind.

And btw - the baby HAS to be accepted by the parents - there is no refund or exchange policy - you can't change/reject defective babies !!

This is why there has to be lot of paper work and a doc is involved with the mom at all stages to ensure the pregnancy is carried to term in a wholesome environment with a good diet and proper weight gain and all sonograms checks in place.
I read a big article about this recently - the docs dealing in this actually have a nursing home where the mom has to stay compulsarily till she gives birth. So as to ensure the doctor has access to them at all times and the woman is not living in a slum environment and gets a proper healthy nutritious diet.

@blue - as far as I know, there is no law in India that governs surrogacy. All the contracts are between intended parties (doctors are generally like middlemen). The doctors/nursing home take care of the paper work and also monitoring of health of the surrogate mother.

@red- I have also read similar articles- they do it because the surrogate mothers are from poor background and there is no guarantee that the money paid to them for their own nutrition will not be utilised for other purposes by the family.

@ bold- there is no policy as such but the people who want ready made child will not bargain for defective baby- perhaps such a baby will be dumped and they will order another baby.

Dumping a "defective" baby is pure conjecture. I doubt we have all become such monsters that we wud just squeeze the life out of an infant coz its not perfect.
I doubt people are this callous towards their own babies. It is more likely the doctors catch the abnormality sooner than wait till the birth.

We are discussing hypothetical situation only. Do not know whether they will show surrogacy in serial or Ganga and the baby will survive (just like Gahna and Nandu). So dumping a defective baby was said about a fate that Anuja suffered or may be the parents compel the nursing home to give such a baby to the surrogate or some orphanage.
