Without a doubt, Abhimanyu might genuinely have love for his son Abhir, but the selfish and egoistic nature of his mother is causing significant damage to everything. It is crucial for the court to consider that the family receiving custody of a child should also provide a peaceful and happy environment, rather than a chaotic one in my opinion.

I fully agree that the environment in the Birla house is far from peaceful and healthy.

Grandparents are typically loving not selfish and prioritize the well-being and happiness of their grandchildren, which Manjari clearly disregards.

All Manjari has ever been and will ever be is Abhimanyu's mother. She never fulfilled the role of a mother-in-law to Akshara or a mother to Arohi, and she will never be a selfless, loving grandmother to the children. Relationships cannot be solely based on birthrights and blood connections; they require effort and work.

Still my point is, Abhinav and Akshara made their efforts and Abhimanyu called her back but refused to listen to them and said he doesn’t have anything to do with Akshara and maybe the child too.So, I can’t understand how it’s illegal for Abhinav and Akshara to raise the child in a safe and happy environment.

That's the verdict of the court, Abhir being Abhir Abhinav Sharma was termed as an illegal practice carried out by Akshara Sharma and a case was filed against her for her fraudulent activities. It was one of the base of the judgement.

You had compared Akshara and Abhimanyu's rights in your post, I was just clarifying that there was no court order involved when Abhir was with Akshara so she didn't really have the rights over Abhir as Abhimanyu does now.

When parents separate, there is a process one has to go through to acquire custody of the child, which Akshara didn't follow and Abhinav didn't adopt Abhir, so Abhir was staying with them illegally

Illegal means something which has not been authorised by the law, Abhinav had to adopt Abhir with Abhimanyu's consent for it to be legal and Akshara had to file for custody with divorce for Abhir staying with her to be legal

One has to follow legal procedure for something to be legal, which Abhimanyu did.
