Interestingly, the Roe v. Wade case was not about legalizing abortion (as most folks simplify it). It was about the 14th amendment that guarantees equal protection, due process, and privacy. The ruling was that the government did not have the right to intervene in a private medical decision. The effect was that abortion became legal. Since then, many states have de facto made abortion almost illegal by restricting the medical service provision end of it.
The 14th amendment is central to many cases including Brown v. Board of Education, Lawrence v. Texas, and Obergfell v. Hodges. The latter two were challenged in the Alito opinion leak.
Irrespective of whether people support or oppose abortion and/or same-sex relationships, the challenge to the 14th amendment should be of concern to citizens. Opening the door for government overreach into private lives is never good.
It has given the rights back to the states... Now it's upto each state to decide for itself... Yes, and fortunately many states do have laws legalizing abortion. Unfortunately, not everyone will be able to travel for an abortion. And some states are actively restricting travel for an abortion. This makes me wonder if the commerce clause could be invoked. Weed is legal in many states while illegal in others. Iowa cannot legally prohibit from going to Illinois to buy or consume weed. Similarly, states cannot pass cross-border travel for cigarettes or alcohol, or medication for lower taxes. Many people cross borders for medical processes all the time. IVF is cheaper in some states. Bypass surgeries are cheaper abroad. How far can a state go in limited it's citizen's choices.
