i will answer this:

1) Sai didn’t return because Virat harboured a criminal who tried to kill Sai and snatch her baby.

2) Virat just presumed her death based on a piece of cloth.

3) a good attorney will use this point: Virat adopted Vinu with an individual who has a criminal record.

4) Sai didn’t go back coz she was scared for her baby’s life and hers as well coz it was clear that Virat won’t let Pakhi go and wouldn’t take two minutes before snatching their daughter.

5) Sai didn’t go back coz the entire family is full of criminal—she can list everything from the start (reasonable precaution: when you have a reason to believe that your life or someone else’s life is in danger).

6) Sai didn’t inform Virat about Savi for the above mentioned reasons: he harboured criminals, lacks moral code, and committed crimes himself.

in short the guy basically has no defence.

That’s the only logical way .. but when these foolish people have not even divorced .. custody kaise karenge

Sai would have done joint custody if it weren’t Pakhi. Sai walked out of that house cause of Pakhi as she didn’t want her son with her. Simple as that.

Also this is itv and legalities will not be looked into especially in Ghum. If Virat can get a clean chit for hiding a naxal then sai can get full custody of her son.

For me I as a sai fan I wouldn’t question her intentions of wanting custody of her son, she suffered way too much for him and deserves to be with him now. Simple as that.

Also sai can prove Chavan niwas isn’t a safe space for kids. If she wants she can open the crimes committed by Kaku against Devi harinee and what all pakhi has done.

Technically legally Virat and sai are still married.

Sai name was not there in the list of dead people. He just assumed only seeing piece of saree cloth.

They added this dialogue later, sai name was there in dead people list.

So he cant prove that sai is dead in Court..because sai practicing her medical degree she is using her original identity.

In real life 99% of the time custody of children is given to the birth mother only with fair visitation rights to the father if they are around. So called Co Parenting is a Hollywood rich person myth. Even in that situation the birth mother will have the lions share of physical custody. It’s just the way it is.

She isn’t denying Virat joint custody, but her feelings are on high because her son who she thought was dead is really alive. Also Pakhi did an illegal surrogate, so there is no way Sai will allow Pakhi the right to continue raising him. I stopped watching this show a long time ago, but I often come to the forum to see what’s what. Previews etc let me see things going on, as well as IG. It looks like someone is getting shot. I wonder how the makers will do this. They love Neil/Ashwarya so they’ve forced Virat/Pakhi down audiences’s throats, so I think it will be Sai who gets injured.

It is all interlinked.

Sai technically can't file bigamy. But let's say she does. Virat will say he thought Sai was dead. Court will question Sai why she left, and why she hid Savi. Brilliant. Bring Savi out. Sai will bring out illegal surrogacy. Let's say the court will say why Sai didn't make sure Pakhi goes to Jail. Sai can say, coz she knew Virat will misuse his power again.

Sai has a brilliant reason for keeping Savi away. Not only are those family members criminals, they have a police officer protecting them. Sai can easily say she was afraid for her and Savi's safety and so she hid.

Voila! Chavan Niwas goes to jail.

Basically, Sai can't exactly get Virat punished for bigamy. But in this entire scenario, what Virat and his family have done is wrong on so many levels, that Sai will come out as victor, even after all the 'wrongs' she herself has committed, coz, after everything, all her actions become excusable.
