If she approaches a lawyer directly for a custody then she will have to tell the entire story of vinu’s birth, which btw is illegal by all means.

1) ——all four of them will go to the jail on the charges of illegal surrogacy and Vinu would be handed over to child services or Ashwini/Ninad. I’d prefer child services over them or any member of the awful family. She can’t claim the benefit of being coerced coz she had plenty of time during the nine months and after she got Pakhi arrested, which btw she is still not pursuing 🤔

Sai for not reporting the crime even after having the information. Virat and Bhavani for aiding Pakhi… and I don’t want to list the criminal chargers on the so-called positive character.🤗

2) Go to court and file a case against bhaiya for committing bigamy and file for solo custody: very simple this! She can make her case by listing all the crap fest that the entire family has pulled since she first set her foot in that awful house. It would be helpful through this way. A little manipulation would be required, but worth it.

Vinu can call Sai "Aii" and Pakhi "mumma". The scenario of a child having two sets of moms or dads isn't unreal when divorce happens. If Sai got married to someone else then does that mean that Savi will permanently go live with her dad? I guess it doesn't make sense to me why they aren't just going the realistic route of co-parenting. But I should probably not use my brain too much on these shows haha

At present she is high on emotions and not seeing the reality.

And if they take realistic route without any conflicts, how will the audience get toxic drama🤣🤣

After all ghum thrives on toxicity

no, the court decides the merits of the case wrt to the best interest of the child.

You actually made some good points. I haven't watched the surrogacy wale tracks so don't have much idea about them. Regarding your second point I don't think Sai can file bigamy case against Virat. If she does even Virat can show the list of people who died in the accident and claim that he married Pakhi because he thought Sai was dead. Plus the court will question her why didn't she come back to her husband after she survived. Then Savi case will also pop up. Sai hid about Savi all these years. She didn't let Virat know he has a daughter. The case would become super complicated but then 72 hours nonsense is also super crap lol.

That's not true - my cousin in India is divorced and her exhusband has full custody of both the kids.

I've watched the show since day 1 lol don't ask how I tolerated some of these tracks haha

Anyway yes I agree, she will be shown at fault also because she didn't come back after accident and she hid Savi from her father too. It's all a mess and it would be in the CHILD's interest to have joint custody and show some of the challenges of co-parenting maybe. I dunno - I guess they need some toxic masala to keep viewers engaged.

The court decides as per the merits of the case with respect to the best interest of the child.

As far as I know there is a certain rule that if any of the parents get married then he/she would not get the custody of the child unless the other proven as insane/criminal or accused as uncapable to be a parent. Most probably now Mast hai jee+Putnajee will try to prove Sai a bad mother to take away Vinu.

Also in India+world usually the mother gets child custody more as she gave birth/kept child in womb. So birth mother vs genetic mother or Yashoda/Devki fight is on the way.

No, the court can award the custody to anyone amongst the two based on merits of the case.
