When a girl and a guy are below 18 and 21 years respectively. The marriage is not illegal per se but it is voidable when they reach the legal adult age and any one of them, if he/she wants can move the court for annulment of such marriage.

So, this judgement has nothing much to do with Marital rape per se, but it is a step to protect the child brides from lusty adult males.

Because, the last time this question was put up, the crusaders of Mohammaden law didn't quite like it and an exception had to be made keeping in view their personal laws.

the law says so but the Supreme Court is calling it invalid. So, the Parliament will have to change the said law now.

But it's not only mohammedan who are having child marriages in india so hiding behind mohammedan law is futile .Rajasthan leads the country in this and guess what ...majority of them don't follow mohammedan law.

We do have a Prohibition of Child Marriage Act which is only Applicable to Hindus. It penalizes people involved in child marriages and gives thee kids a right to annul such marriage when they reach the legal adult age.

Indian is ranked one of the worst countries to be a woman in.As much as I like visiting India and the country, I hope in terms of women and LGBT right, it progresses. India is soon going to a powerhouse superseding U.S. so it would amazing if they could a positive direction on these issues. Ironic how India is my research topic nowadays and my dissertation in global health starting next semester.

The public Healthcare system of the country sucks but, ironically it is one of the mkst sought after destination for MEDICAL TOURISM.

Only making a law doesn't help ...as per these reports more hindu children are getting married :

of course, it does. U.S. sucks in this medical department too b/c it's bloody expensive. One ultrasound I had for cyst cost me around 1000 dollars which mind you after insurance for a student like me is still 500 i have to pay back. I get kicked off my parent's insurance after next year.It's sought after because it's affordable for foreigners like us. I am coming myself to get some dental work there in few weeks, but with money, it has the technology.

India really falls below average on maternal care and sanitation. It needs an improvement on it, no proper contraception and sanitary pads. The rural area woman do really need proper access to basic things.

India might be medically sought after for foreigners but clearly failing many indian citizens, myself having 3 cases in family where after spending lakhs and lakhs of rupee we got nothing and lost young family members...now we have developed the fear that going to hospital means not coming back home at al .
