Himesh sued for 5 crores over Karzzz song

Blaming the music director Sameer and renowned singer Himesh Rashammia for intentionally steeling his composition of a popular song and using it in his latest movie ''Karz'', an NRI Punjabi singer today issued legal notices to both of them and claimed damages of Rs five crore.

The singer, Kulwinder Kally, in his notice claimed that the number 'Soniye Je Tere Nal Daga Main Kumawn Rab Kare Main Mar Janwan' was his composition in his music album 'Sham Wali Gaddi'.

The song was written by Shaonki Khan of Pakistan. Kally further claimed that he had the copyrights of this number.

Kally in his legal notice demanded damages of Rs five crore as compensation from the music director and Reshammia for violating the Copyright Act. He warned that if within 15 days, the duo did not respond he would initiate criminal proceedings against them in court.

Well it is a great song. I think worth 5 crores.

Himeshji should go thru proper channels.

Given Himesh's penchant for staying original, how did he pass this tune as his own?

OK some are claiming that this is actually a folk song and no one has copy right for this but AFAIK this was in 2002 album of Kally. Lets see what turns out of this case, thanks for sharing with us Salil. This news is hitting several blogs at the moment.

This is only one side of the picture. This song actually belongs to Hussain Baksh Gullu's(A well know pakistani classical singer). After his death his family sold the copy rights to Kulvinder kally. Kally has sung this song in the album which belongs to T series. Hence Tseries has also rights to use this song.

I hope you can see a label of T series on the album.The problem is the pakistani singers rights belong to Kally so kally is claiming this song but according to T series the ablum belongs to them so they have rights to use this song anywhere they like.Himesh has not been registered as a music director for this songs instead he has registered himself as a Music Recreator. Even Bhushan Kumar of T series have decided to issue legal notice to kally and from some of my friends I even came to know that they have already sent legal notice to kally.
