Doesn't matter. The intent is what's at issue here. If I shoot a guy trying to kill him, and miss, the fact that I'm a bad shot shouldn't imply that my sentence would be lighter - it would still be attempted murder. Similarly, even if the Pande punk was dead, the fact that Devika was acting in self defense should be enough. Or imagine this - let's say somebody was trying to rape her, and she grabbed a knife off his hand and stabbed him - would she then be at fault for homicide?

What makes this complicated is Sudha's schizophrenic attribute - had Devika been an original individual, rather than a derivative personality of Sudha, who could have given the police an original and accurate statement, things would have been fine. However, the fact that Sudha has no recollection of what Devika faced and did makes it look like Devika had something to hide, which she didn't, and that's what makes this worse.

Hopefully, tonight, when Kalpana interrogates her and she discloses what really happened, the police will let her off.
