ok I'm confused don't you need divorce papers if your marriage was registered in court?
If you go through only the religious marriage ceremony especially in a village, then would you still need divorce papers??? Do villagers register their marriages as well? Please somebody clarify?
I know that Talaaq exists in Muslim marriages with/without paperwork, but does divorce exists in Hindu religion marriages?

As far as I know, in any village there is a magistrate type of person. Even with religious ceremony, the marriage will be registered there.

From what I have heard and know, a Hindu marriage need not be registered for a divorce to happen. If there are enough witnesses to prove the marriage took place, or photos or video available, that can be admitted as evidence in court.
In this case, because DM and Santo have been married for only 6 months, court will not grant divorce. They have to be married for at least one year. Even after that, divorce by mutual consent will take 6 months. So we are talking about one full year before the divorce can actually happen. That too, only if DM signs the papers. Until then, Santo and DM's marriage will be valid, in the eyes of the law, and society.
In some states, registering a Hindu marriage is compulsory. don't know about Gujarat.

If their past shows are anything to go by, in BT world anything can happen. BT world's legal and medical systems defy all logic.

@ rasika ....

agree with u....

I think the marriage certificate issued by the purohit (or the pandit) who conducts the hindu ceremony is evidence to prove that the marriage actually took place. And as rasika pointed out any other form of evidence is also accepted by the court in case of a Hindu marriage...

@ opti....

that is y we r watchin a serial....and that too BALAJI.....where they can even defy gravity let alone legalality and medical....

🤣

You still need divorce papers.
If you think about it, what you're actually asking is if a marriage according to Hindu ceremonies is legally valid. Yes, it is.
You need a certificate from the pandit as well as affidavits from at least 2 witnesses.
There is no divorce in the Hindu religious tradition, but it exists in India today, and most marriages, whether they end in divorce or not are still not registered.

Their marriage is legal.....the hindu marriage act can grant divorce on these grounds that too if proven: and this law is prevalant all over the country! all hindu marriages...

1. Infidelity
2. Cruelty
3. Religious reasons( if one of the parties wants to become a saint etc)
or Mutual Consent: in this case both the parties decide to part mutually...but they should have resided together for atleast 6 months...here the court intervines and gives counselling or some kind of advice and some time to think...and this is signed in 2 notions 1st and 2nd and normally 2weeks to a month (maybe 6 months in some cases) is given between the 2 notions.

I dont know how they show it here....maybe in the disclaimer they show that they do not follow medical/legal practices...
