The Channel is telecasting the program "KAUN JEETEGA BOLLYWOOD KA TICKET" ("Program") every Sunday which started from 6th July 2008 at 20:00 hours.

During the Poll, the Channel will telecast the Program every Sunday from July 13, 2008 at 20:00 hours.

The Poll for the Program shall commence from Sunday, July 13, 2008 at 20:00 hours upto September 22, 2008 at 12:00 hours on the Channel.

INX reserves the right to change the dates, the timings and/or days of the Program, without giving any prior intimation to the viewers and/ or voter.

During the Poll, the Channel will telecast the Program every Sunday from July 13, 2008 at 20:00 hours.

To participate in the Poll, the viewer(s) and/or voter(s) must watch the Program. The viewer(s) by participating in the Poll will get an opportunity to cast their vote for any Pair(s) participating in the episode of the Program.

A viewer(s) and/or voter(s) interested in casting their vote for their favorite Pair(s) in an episode of the Program could follow either of the steps stated herein below: 8.1 Via SMS – Viewer(s) and/or voter(s) could SMS from their Airtel, Vodafone, Idea cellular, BSNL, Tata Indicom, BPL Mobile and Spice Tele as stated herein below:
8.1.1 The viewer(s) and/ or voter(s) must SMS <Ticket><space><Contestant code> to 56644 i.e. the keyword "Ticket" followed by space and the numeric code that has been allotted to that respective Pair(s) in the episode(s) of the Program as more particularly mentioned in Rule 3.
8.1.2 Each SMS shall be charged by the respective mobile operators at the rate of Rs.10/- (Rupees ten only), if the message originates from the home circle of the Service Provider whose services are being availed by the viewer(s) and/or voter(s). In case the message of the viewer(s) and/or voter(s) originates from outside his home circle, applicable roaming charges shall be charged by the Service Provider to the viewer(s) and/or voter(s). 8.2 Via Internet – Viewer(s) and/or voter(s) will log on to www.9xtv.in, register himself/herself and follow the instructions on the website to vote for his/her favourite Pair(s).
8.2.1 Maximum number of votes that a viewer and/or voter(s) can send via internet is ten (10) votes per internet session i.e. the session will start at 20.00 hrs on the date of which the episode of the Program will be telecast i.e. Sunday and will end on Monday i.e. the following day on which the episode will be telecast at 12:00 hrs. In the event, a viewer and/ or voter(s) sends more than ten (10) votes per internet session, the votes shall not be counted and will be considered as null and void.
8.3 Via Tata Tele – Viewer(s) and/or voter(s) could SMS and/ or call via Interactive Voice Response ("IVR") from their Tata Indicom Mobile only as stated herein below:
8.3.1 Via SMS: The viewer(s) and/or voter(s) must SMS <Ticket><space><Contestant code> to 58282 i.e. the keyword "Ticket" followed by space and the numeric code that has been allotted to that respective Pair(s) in the episode(s) of the Program as more particularly mentioned in Rule 3.
8.3.2 Via IVR: The viewer(s) and/or voter(s) can also call 58282 and say "Ticket" followed by the numeric code that has been allotted to the respective Pair(s) in the episode(s) of the Program as more particularly mentioned in Rule 3.
8.3.3 Each SMS and each call via Tata Tele shall be charged by the mobile operator at the rate of Rs.10/- (Rupees ten only), if the message originates from the home circle of the Service Provider whose services are being availed by the viewer(s) and/or voter(s). In case the message of the viewer(s) and/ or voter(s) originates from outside his home circle, applicable roaming charges shall be charged by the Service Provider to the viewer(s) and/or voter(s). 8.4 Subject to Rule 12 and 15, the weightage given to the voting via SMS, Televoting and the internet votes will be calculated as one (1) SMS vote =(equals to) one (1) Tele-vote = (equals to) three (3) Internet votes. 8.5 The cost of each SMS/call shall be charged by the respective Mobile Service Provider and/or Landline Service Provider, as the case may be. Neither INX Media Private Limited ("INX") nor the Channel nor EY (defined below) shall be responsible in case of any network problem and/or the costs charged by the Mobile Service Provider and/or Landline Service Provider and/ or otherwise. Any dispute in connection to the same should be settled directly between the subscriber and the Mobile Service Provider and/or Landline Service Provider without involving INX and/or the Channel. | - Viewer(s) interested in voting for their favorite Pair(s) in a particular episode of the Program, must send in their entries within the time period stated herein below:

Vote(s) sent after the time period stated in Rule 9 herein above shall not be considered and shall be null and void. In addition it is clarified herein that INX has the exclusive right at its sole discretion to increase and/or decrease the number of episodes of the Program and/or change/amend the last date for voting date for each week (as stated above) and/or the voting end time for each episode and/or discontinue the Poll and/or otherwise, without giving any prior intimation, at any time whatsoever.

Ernst & Young Private Limited ('EY') a company duly registered in India shall collate and count total number of votes received via SMS, IVR and internet. It is clarified herein that the collating and/or counting and/or the result and/or outcome of such collating and/or counting shall be the sole responsibility of EY and in no event INX will be responsible in any manner whatsoever for the same.

The Program, will have 4 (four) permanent judges/mentors ('Judges') each from the four zones as stated in Rule 3. The Judges will give points to the maximum of 10 (ten) points in the form of "Tickets" in accordance with point system i.e. the Judges will give Tickets to the Pair(s) for their performances. It is hereby clarified that the Judges representing the particular zones will not give Tickets/points to the Pair of his/her respective zone. The ticket values are: Platinum Ticket will have a value of 10 (ten) points, a Gold Ticket will have a value of 7 (seven) Points, a Silver Ticket will have a value of 4 (four) points and a Black Ticket will have a value of 1 (one) point. ('Judges' Points')

Enabling a particular Pair(s) to participate in subsequent episode(s) of the Program or elimination of a particular Pair(s) from episode number three (3) of the Program shall be in accordance with the provisions of Rule 13 and in the following manner:
a.The final marking system will be based after adding the total marks received from Judges' Points and number of votes received by Poll. The two will have equal.eightage, 50% weightage of the Judges' Points and 50% weightage by the Poll ("Final Marks").
b.Thereafter on the basis of the Final Marks received by a particular Pair(s) in an episode the two pairs who have received least Final Marks will be placed in the bottom two (2) ("Weakest Pair(s)").
c. Out of the Pair(s) i.e. the Pair(s) who are not the Weakest Pair(s) will, on camera of the Program, vote for either of the Weakest Pair(s) who are in bottom two (2). One of the Weakest Pair(s), which receives least votes from the rest of the Pair(s) will be eliminated subject to Rule 14 (d). In case of a tie, the actual Pair out of the Weakest Pair(s) that ranks at the bottom as a result of Final Marks will be eliminated.
d. Any Pair(s) that gets ten (10) points from each of the Judges i.e. thirty (30) point will get an immunity from elimination for the next episode. -
INX has/have the right to prospectively and/or retrospectively cap and/or limit the number of votes sent in by voter(s), to enable a fair representation and/ or for any other reason, for any number of episodes, as deemed to be appropriate by INX. It is further clarified that INX also retains the right to modify and/or change aggregation methods with regard to selection of Pair(s), including but not limited to the said modification and/or change through application of weights as required by INX, for the same from time to time -
It is expressly stated that this is simply a Poll to enable the viewer(s) and/ or voter(s) to vote for their favorite Pair(s). Therefore, there shall be no winners declared and/ or Prizes distributed for this Poll.

PART B - GENERAL RULES:

INX reserves all rights to make amendments to the existing rules without any prior notice. -
The viewer(s) and/ or voter(s) interested in participating in the Poll must be above the age of 18 years and a resident of India. -
The viewer and/ or voter(s) of the Poll agree that he/she will indemnify and keep indemnified and hold save and harmless the INX , its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Poll and shall also not file in person/ through any family member and/or any third party applications, criminal and/or civil proceedings in any courts or forum in India against the sponsor and/or INX to claim any damages or reliefs. -
INX is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the viewer(s) and/ or voter(s) in any manner whatsoever, in connection to the Poll. -
Employees of INX, and the members of their immediate family, persons with criminal convictions and persons other than citizens of India are ineligible to vote and be a part of the Poll. -
The participation of the viewer(s) and/ or voter(s) in the Poll will mean that the viewer (s) and/ or voter(s) has read, understood, accepted and agreed to abide with all the rules including the general rules of the Poll. -
The outcome of the Poll/the decision made by INX regarding the Poll shall be final and binding on the viewer(s) and/ or voter(s) and in no event shall the viewer(s) and/ or voter(s) dispute the decision made by INX and/or its employees in connection to the Poll. -
The terms of these rules will be subject to laws of India and will be subject to the exclusive jurisdiction of the courts in Mumbai. -
The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Poll shall be referred to a sole arbitrator appointed by INX and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai and the same shall be conducted in English language. The costs, charges and expenses in connection to arbitration shall be solely borne by the viewer(s) and/ or voter disputing the same
