I don't think when the case goes to court, it will be to prove that Sushant was not under depression and that he was murdered. This is the theory of some sections of the media and the general public.
The family itself has filed a case under abetment to suicide. So this means, they already accept that Sushant did commit suicide. (And it's too late to change it to anything else, because the body is no more and a second post-mortem cannot be conducted by an independent forensic agency to determine the cause of death.)
The case, when it ultimately goes to court, will be to prove the reason behind his suicide. Was it because he was suffering from mental health issues so severe that he ultimately ended his life and no one can be blamed for it. Or was it because he was harassed so much (presumably by Rhea and her family) that caused him to slip into depression and that ultimately led him to take his own life.
Which is why it is morally and most likely legally wrong for the therapist to have spoken about Sushant's condition in public. This is the main thing around which the entire case revolves, why he took his own life? So surely, a therapist, who will be one of the prime witness when the case comes up in a court, is not supposed to go public with a statement like this. Her credibility has already been damaged and while she might still be able to testify in court, the lawyers for Sushant's family will definitely have an upper hand in proving her an untrustworthy witness, who broke the law of patient confidentiality in public.
