The first link you posted was maybe a mistake? Not sure what I am supposed to see?

Here is the Indian law with genders in bold:

IPC 354D: Section 354D of the Indian Penal Code

Stalking1

(1) Any man who—

  1. follows a woman and contacts, or attempts to contact such woman to foster personal interaction repeatedly despite a clear indication of disinterest by such woman; or
  2. monitors the use by a woman of the internet, email or any other form of electronic communication,commits the offence of stalking;

Provided that such conduct shall not amount to stalking if the man who pursued it proves that—

  1. it was pursued for the purpose of preventing or detecting crime and the man accused of stalking had been entrusted with the responsibility of prevention and detection of crime by the State; or
  2. it was pursued under any law or to comply with any condition or requirement imposed by any person under any law; or
  3. in the particular circumstances such conduct was reasonable and justified.

(2) Whoever commits the offence of stalking shall be punished on first conviction with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine; and be punished on a second or subsequent conviction, with imprisonment of either description for a term which may extend to five years, and shall also be liable to fine.

1 Criminal Law (Amendment) Act, 2013

There is no specific cyberstalking law. There is a law against emailing obscenity and there are protections for emailed threats and/or extortion but the police don’t seem to take her dirty pictures or threats against him very seriously.

I think she wanted the bragging rights that would have resulted from boinking and dating Hrithik. Let’s face it, Hrithik is out of her league- be it looks, personality, industry status, family lineage, etc. To have him would have been a dream come true for her.

Unfortunately, the unrequited love and pain of rejection progressively manifested into obsession and stalking. And what we see now is an unstable individual unable to come to terms with the reality in front of her. She has waged a full-on war after her advances were rejected.

Who knows how far her obsession will go but what is evident is that she is not of sane mind. She does not exhibit the traits of a normal-functioning individual who uses logic and reasoning. She fails to comprehend the concept of consent and boundaries. Honestly, I wish the people around her cared enough to get her professional help rather than enabling her behavior.

The legal services operate in many cities in India. So that's why I posted. I had watched a program on cyber stalking on TV. There were many IT experts who shared cases. Wii try to see if I can get hold of some reference.

Agree that specific to cyber stalking is not there but in IT act there are provisions.

Section 66A in The Information Technology Act, 2000

[66A. Punishment for sending offensive messages through communication service, etc.–Any person who sends, by means of a computer resource or a communication device,– (a) any information that is grossly offensive or has menacing character; or (b) any information which he knows to be false, but for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred or ill will, persistently by making use of such computer resource or a communication device; (c) any electronic mail or electronic mail message for the purpose of causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the origin of such messages, shall be punishable with imprisonment for a term which may extend to three years and with fine.

Section 67 in The Information Technology Act, 2000

77 [ 67 Punishment for publishing or transmitting obscene material in electronic form. -Whoever publishes or transmits or causes to be published or transmitted in the electronic form, any material which is lascivious or appeals to the prurient interest or if its effect is such as to tend to deprave and corrupt persons who are likely, having regard to all relevant circumstances, to read, see or hear the matter contained or embodied in it, shall be punished on first conviction with imprisonment of either description for a term which may extend to three years and with fine which may extend to five lakh rupees and in the event of second or subsequent conviction with imprisonment of either description for a term which may extend to five years and also with fine which may extend to ten lakh rupees.

I think some childhood trauma that's still untreated..! not having a stable and loving childhood.. makes people do some irrational shit specially if you throw the glam environment in the mix! with some partying and coco on the side.. 🤔

Obviously we haven’t seen most of the 3000+ emails but with the exception of one, what we have seen aren’t threats. Nor are they for the “purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred or ill will”. They were those things but they weren’t her purpose. Her purpose was to seduce him into a relationship. They are creepy as 🤬 but unfortunately since she’s female that’s not illegal. The police not just in this case but in multiple cases involving men harassed by women seem to take the view that either women wouldn’t do that or men shouldn’t be bothered by it anyway so usually don’t even investigate.

I do suspect that the Roshans tried or at least threatened to have her charged for sending obscenities through email because she FREAKED out and went on a “he’s trying to put me behind bars, 🤬-shame, spread my nudes” media rampage. Immediately after that there seemed to be a period where she came really close to admitting it was not a physical relationship and then stopped talking about it - which may have been negotiated as her lawyer claimed there was an agreement at one point -and I think Roshans backed off thinking she’d let it go and that would be better for everyone. Then Simran promotions started and she was back on a tear even admitting she would be in jail if Hrithik weren’t “so dumb”.

Anyway, I do again encourage you to read the article as there are examples of men the police can’t/won’t help because of the law and cultural beliefs. It’s not just Hrithik.

Edit: Regardless of whether or not we think Hrithik should have tried harder to have her charged with sending obscenity through email (assuming he didn’t behind the scenes), it no longer matters as I think the statute of limitations has run out if she hasn’t emailed anything since 2015 (any lawyers know for sure?) He must have done what he thought was the best for everyone at the time. It’s very easy to second guess when you know what happened next.
