I feel just cause its Sanjay Dutt you are being extra critical on him and thinking that his treatment is not equal. It may also be the case that there are political reasons to make Sanjay Dutt the scapegoat and the real reason can also be to end Sunil Dutt's political career.
Vijay, it is our case that there are political reasons to make his escape the noose (so to speak, figuratively speaking)!
In fact, forget being a scapegoat, he is getting it off easy.
Fact remains that FIRE ARMS and HAND GRENADES were recovered from his house. Fact remains that Abu Salem had visited him during the period preceding the incident.
For similar acts, others have been sentenced under TADA and he alone has been held under the Arms Act, with just another person, I think.
Possession of Arms, particularly the ones like AK 47 or 56 are not meant for personal protection alone and in any case, post the Bombay riots, Bombay was declared as a notified area and possessing of fire arms of this kind was not permitted in Mumbai, and anyone found with it was held under TADA.
So why was the charge under TADA removed and he convicted under the Arms Act alone?? One reason could be that under Arms Act, the sentence is lower.
There have been many deviations from procedure in his case. Any person convicted is always immediately taken into custody. sanjay dutt was convicted but left out, till the date of his bail. How was he different from the other accused? Or did the other accused not have families or other priorities to attend to???
This is where the inequality stands out!
