nakusha, if the ladki was detained in a military controled area or if the area came under AFSP Act, Major dutta would hav been totally justified for his action... since the entry was almost without any force n he resolved the whole issue with cordial discussion he could be spared frm any police case n also the argument would be that he was on his duty of finding the missing officer..he could get away with this argument i feel 😉.. waise major warned parekh of such an intervention even b4 he left😆. this conflict arise on a routine in courts whenever an armed forces personnel is involved in any matter, civil/criminal n slightly ambigous provisions hasnt helped much.Originally posted by: Hamlet53
.parakeh thinking of mama peh case military court .i think wht happen between khan & mama is criminal case & military can't interven .lot of rules were broken local police had to be involved army can't step into somebodys home & they weren't terriost or waging war against country .search warrant had to be issued FIR has to be launched at local police station under IPC unlawful confinement of an adult , miltary is n't involved in civil cases & criminal even if the victim happened to be a army officer .thankfully coz of strict restiction we haven't faced military coup .democracy has survived . well done lardki! touche! you are spot on .and for that i am well pleased... thank heavens you understand ,still I tried to resolve this issue as best as I could..
