Really Magno, I am not sure about that going by his shocked expression on Thursday. The finality of Prachi's words really seems to have hit the guy hard.

Agree with you Opti dear.....hearing her say the words.....is when reality of what he wanted hit him.....

Ryka, did not see this para earlier. Did you add it later? Anyway my take on why they employed a lawyer is to fight the case if Milsi levels accusations at her, not to give explanations as to why they were now contesting a case where they had initially given consent.

This is keeping in mind K-land legal logic because after Milsi testified, the judge did not call Prachi to ask her stance and allowed Milsi's lawyer to give the grounds for the divorce. And the judge never bothered to intervene and ask why an incompatibility case is being argued as one of adultery. So by their logic a case can change from mutual consent to one of contention without any problems and the arguements can also be immediately placed before the court.

I think he did mean the word divorce. He got all the wrong 'facts' and I really don't think he didn't mean it when he said 'divooorrce!!!'. It's just his heart disagreed with his firm decision made by his brain, hehe.

As for his shocked look, it's not because he wasn't dead serious with the divorce but because... errrm Prachi just told him the night before she wouldn't divorce him. So he's just surprised. Plus all the strange happenings in the silly court 😃

Opti, If u got the requirement of a reason checked by a Legal advisor... then I agree. Having worked for a considerable amount of time in such a setting, i know for a fact that there are to many procedural hindrances...one of them is surely a written representation.. .and a representation would mean nothing without reason.
Just to withdraw the case, u need to make an application in a prescribed format... and that surely will have details for your withdrawal... because the other party needs to be intimidated. Yes, it is family court... the prime concern will be to a save a family...but even they are guided by prinicples of natural justice... so the other party will be given a intimation of the reason at the least....for them to prepare on the next requirement.

Trust me when i say this... there is a Legal Act and then there are Rules prescribed... they are two different subjects in itself. They are two fat books and are different... most of the time when we read the rules we come across a different intepretation to the Act/Law... you have a seperate chapter on intrepretation of laws and how the maker of the law wants you to intrepret it and on what grounds one can override them and if that overruling judgement becomes a law or just a specific caselaw. More often the Law in itself is open for intrepretations... which is why u have Rules as a seperate book to guide u through along with procedures & format of those procedures at every stage and the Rulings which just might change the interpretaion of law or overrule any law.

It is very tricky, Opti... Net based info will just give u a broad view...the intricacies of the Act and the Rules coupled with rulings is something the lawyers themselves work on continously and changes from case to case. Our legal system is very complicated(and thankfully atleast for ppl like me who makes a career out of it😆) When I know abt Hindu undivided family, I have no idea of the Hindu Marriage Act😆 because they fall into different subjects itself, while the 1st will be commerce, the other one falls into social. And my advice... dont do so much of hard work over Kayamat... it is obvious that those guys dont😆

So the main issue here is Milind wants a Divorce and Prachi doesnt want it and wants to fight for it. And now it is irrelevant because there is no Divorce happening😃

@ Magno... yes dear.. according to Muslim Law.. you get a Divorce if you say the words trice (i think infront of a qazi) And you can marry the same person again. But if the divorce happens again... they cant marry the same person without marrying someone else before and divorcing them.

& Krishna - I know what kind of care you & Shali will take of Milind😆 But sorry sweety... he is just NOT coming your way! He needs peaceful environment around him... not over excited ppl who dont even give him a chance to introspect his life in privacy😕😆 So Sorry... he is under my custody and remember according to u, I am his ever loyal Commander and so his security is in my hands and he is going to be escorted away 🤣 So just give up that thought😡 May be u can help Prachi to track us down😆

Milsi and Prachi need to go on this guilt trip together...so if I have to...I will track Mills down so he can take that trip with Prachi bhabhi.😃
