So, criminal courts and civil courts are different entities. Unless Patralekha has active criminal cases PROVED against her, the court will have no business restricting her. And the court will not take anything into account while granting custody but the best interest of the child. Given both the biological parents have never actively (read : legally) protested against Patralekha, Court would assume their consent in matters. Plus you can’t sleep on your rights.

Yea, custody would be given to Virat. Or the court might even declare all of them unfit and send the child to a welfare home as a Child in Need of Care and Protection. Sai’s chances of getting custody are very slim unless she proves that she’s the best option available over others - which frankly, doesn’t seem possible.

Yeah in the real world even with my limited knowledge of law, I think VP should lose custody since the crimes they have committed can be proven. If the case is filed, they'd both be found guilty. Its just that no one complained. But Sai definitely may not get custody unless she proves she's the best option. Which is feasible only if Vinu even accepts her aai but he doesn't. In the real world court would have found everyone unsuitable and sent child to welfare home.

The one thing Sai has in her favor is that she never gave up rights on the child voluntarily. She was led to believe he's dead in an accident, couldn't trace him and only now she knows he's not dead. she made her intention clear when she filed complaint before the accident and left because P was seen as dangerous.

Thats why I had hoped Sai would have fought the legal battle . Even in the OTT itv tamasha , it'd been good to see VP actions come to light . But she didn't follow through because its ITV world. Varna her rationale that Vinu should not come to court is BS. There was no way she could have filed a case for custody and hoped for a favorable outcome without Vinu ever being questioned or asked for his opinion. It was a huge disappointment.
