S - court summons, case for who gets custody of Jaspreet
Kashish looked at Sujal sadly
Part 9
It was the day of the court case, Sujal and Kashish were in the car on the way to court
K - Sujal, who's our lawyer?
S - who else? Kavya of course
K - will he win the case?
S - definately, don't worry about it
K - I'm feeling restless, i don't want to lose Jaspreet
S - don't worry
Sujal held Kashish's hand, soon they arrived at the court, Jaspreet was at home with Veena. Sujal and Kashish met up with Kavya
Kav - hey guys, Kashish bhabhi don't worry, everything will be ok
Kashish smiles until she catches sight of Ganga with her lawyer
S - who's her lawyer?
Kav - if im yours then its certain that hers will be my enemy
Ganga's lawyer walked up to them
L - hi Mr Kavya Nanda
Kav - Mr Yug Mittal
Y - so do you think you will win?
Kav - no question, in case you have forgotten, I have won every case til date
Y - we'll see
Everyone went inside, Ganga sat on the prosecuters side with Yug, and Kashish and Sujal sat on the defence side with Kavya. Everyone stood up for the judge and sat back down, soon the court procedures began
Y - your honor, this case is as clear as crystal, my client Mrs Ganga had left her daughter Jaspreet in the care of Mr and Mrs Garewal thinking that they would return her once my client returned, but that was not the case, when my client pleaded and begged Mr Garewal to give her daughter back, Mr Garewal plain refused
Kav - your honor, my capable colleague has left out an important detail, when Mrs Ganga left her daughter, she did not simply hand her over to them ensuring them that she would be back but simply left her outside on their doorstep with a note. Now my clients have fully provided for and taken care of the infant for almost half a year, if in that time my clients got attached then how are they to blame
Y - that is a valid point, they are not to blame for getting attached, they are being blamed for refusing to give back someone else's daughter
Kav - your honor, I would like permission to present my first witness, Mr Sujal Garewal
The judge granted the permission, Sujal stood up and walked to the witness box
Kav - Mr Garewal, could you please tell us what happened the day you and your wife found the baby?
Sujal gave his account as to what happened, next Kashish was called and she did the same, after Ganga was called to give her statement
G - me and my husband were married against his familiy's wishes which is why we moved away from them, that was when I had Jaspreet, but they found us, my husband Sahil was scared that we would be separated so he returned home to try and soften the matter but things got worse, they tried to marry him off to someone else, tell me your honor, which woman would allow her husband to marry someone else?So to save my husband I decided to go to his home but I couldn't take my baby because I knew they would try to take her from me like they did with Sahil. I had seen Sujal and Kashish around the neighbourhood and felt they would take care of my baby so I left them with her. If I had known they wouldn't give her back I would never have left her with them
Kav - Mrs Ganga, where is your husband now?
G - why?
Kav - it could be that you are just making this story up to get your daughter back, if your husband was here, or a member of his family then maybe it would be a different matter
Y - objection, Mr Nanda is accusing my client of lying in court without proof
Kav - sorry your honor, but still where is your husband?
G - he is at his home
Kav - and does he know what is going on here?
G - no
Kav - Mrs Ganga, you are here trying to fight for your daughter and your husband doesn't know?
G - I didn't want to give him more problems!
Kav - that's understandable, so tell me, how do you plan to provide for the child?
G - she is my daughter, I will do everything necessary
Kav - well currently you are unemployed, you have sold your house and you are staying in a bed and breakfast, is that where you plan on taking your daughter?
G - .......
Kav - exactly Mrs Ganga, my clients Mr and Mrs Garewal have a house in their name, Mr Garewal has a well paid job and a secure family, so why should you get the custody?
G - because I am her mother!
K - but where have you been the past 5 months? Where were you when she said her first word? where were you when she took her first step?
Sujal pulled Kashish back down
S (whispers) - Kashish calm down....we can't lose this case (out loud) sorry your honor
Kav - but my client has valid points, Mrs Ganga what was your daughter's first word?
G - what....?
Kav - I understand that a child's first word is treasured by the parents, so what's her first word?
G - I....do not know
Kav - point to be noted your honor, Mrs Ganga, who is trying to get custody doesn not even know her daughters first word
Y - your honor this has no relevence in this case
Kav - but it does Mr Mittal, Mrs Ganga has been absent from her child's upbringing for 5 months, she may not even know what her daughter likes to eat, so how will she feed her?
The court case carried on and several witnesses were presented in favour of Sujal and Kashish. Kavya was on the verge of winning the case when....
Y - your honor, I would like permission to call my final witness, Mr Sahil Virani
Sujal, Kashish and Kavya were shocked, they watched as Sahil (frm kyunki) walked in and stood at the witness stand
Sa - your honor, it is true I did not know about this case until Mr Mittal contacted me two days ago, from then I have met him and given him all details concerning me and my family. My wife has told of how my family tried to get me married to another woman which is why she left our daughter in the care of Mr Garewal, but that was where her mistake was, I have found out that Mr Garewal had neevr wanted Jaspreet and tried to give her away to social services but was forced to keep her because of his wife, how can I let my daughter stay with such a man? I did further digging and found that Mr Garewal was abandoned as a child by his father, it is possible Mr Garewal would do the same thing with my daughter
Sujal was furious, he stood up
S - that is personal!
Y - please Mr Garewal, come to the witness box
Sujal went to the witness box
Y - is it true you tried to pass the child off to child services?
S - yes but..I...
Y - yes or no?
S - yes
Y - and is it true your father left you as a child?
S - ....yes
Y - and is it true, you initially did not want anything to do with child?
S - yes, but your honor I love her dearly now, me and my wife haven taken care of her for 5 months, she takes me as her father, how can you take that away?
Judge - Mr Garewal I will make the decision, please sit down, the court is adjourned, the decision will be told after a fiften minute break
The break took place, Kashish cried in Sujal's arms, Kavya looked glum
S - will we still be able to win?
Kav - from this angle, I..don't know, god knows where he found out all that information
K - we can't lose her, do anything Kavya
Soon the break was up, the judge returned and gave the verdict in favour of Ganga and Sahil as they were the biological parents, this devasted Sujal and Kashish.
