When the family registers the case in Patna, it clearly wants the case to be TRIED in Patna as well. If there intention was just to get the CBI Involved, The Mumbai Police wasn't co-operating & they had to involve Bihar then they should have no problems transferring the FIR now with the CBI on board.
It'll be interesting what the Supreme Court decides tomorrow but it's highly unlikely that the defendent will get a fair trial in Bihar and that alone should be the basis of the FIR Transfer.

I too think that the FIR will be transferred to Mumbai.
That being said , I understand why family filed a FIR in Bihar, not Maharashtra.
