When you register a FIR in a particular state, the case is investigated and TRIED there. Its not as if, the FIR gives the power to Bihar Police to investigate the matter but it will be tried in the Mumbai Courts.
When the family registers the case in Patna, it clearly wants the case to be TRIED in Patna as well. If there intention was just to get the CBI Involved, The Mumbai Police wasn't co-operating & they had to involve Bihar then they should have no problems transferring the FIR now with the CBI on board.
It'll be interesting what the Supreme Court decides tomorrow but it's highly unlikely that the defendent will get a fair trial in Bihar and that alone should be the basis of the FIR Transfer.
