It was in bad taste from Ajaz. now maybe he is congress supporter and feels that he needs go criticize Modi, but if he start polluting entertainment with politics, then yeah, his choice.

After all, if won't be Modi who makes the issue, but his fans. Movies can stopped from screening and his acting career itself could be affected. He should have thought that he is on National TV.

Freedom of Speech is not freedom to Slander. If he can't prove his allegation, he better apologize and move on. We all make mistakes.

and modi's development.. i dont know how is it possible.. because in 95 % recent survey gujarat is below kerala in development and growth rate..and being a keralite..if keral is abv gujarat, i can imagine gujarat's growth rate...😛

yea..kerala is doing very well, no doubt...and gujarat is too...individually some states do exceed china's growth rate

Ajaz has merely expressed his opinion and it does not constitutes defamation u/s 499 of IPC.

Our honorable Supreme Court has time and again stated in numerous cases that expressing ones opinion by any means is a fundamental right granted to every citizen of this country and this includes even a criticism of a public figure. Statements made against persons in the public eye cannot be considered defamatory unless they were made with "actual malice" ie with an intention to deliberately harm the reputation of the concerned person...REFER to LIC V. Manubhai D. Shah (1993), Express Newspapers (Private) Ltd. v. Union of India..

If Only criticism constituted defamation don't you think there would have been zillions of cases already instituted against AAP and BJP for defaming the current Central government !

It's not criticism, it's an allegation
calling someone 'chor' without proof is certainly not criticism

Ajaz just said chor woh to sabhi politician hote hain. Actually Modi is murderer, stalkers, there are many cased against him. But it is unfortunate for India the pseudo-democratic country that Modi is being considered for Prime ministership.

yet no case stands unless there's reasonable evidence that would suggest that he made that remark with a malafide intention and to hurt Mr Modi's reputation.

The bottom line here is that India has a lot of restrictions on the freedom of expression. The U.S. constitution comes the closest to allowing full-fledged freedom of speech though even there, a few restrictions exist.

India would benefit from having something like that so that citizens can freely discuss rights and wrongs, open discussion is the first step towards improvement.
