IMO, in terms of physical violence:

Dolly vs Samir > KRK bottle throwing incident > Kushal neck grab > Tanisha push + 2 bumps > Niketan Push to Imam > Pooja Mishra grabbing Sid's hand

It would be tough to prove Armaan's verbal exchange as sexual harassment as that also was based solely on verbal exchanges. I don't think Armaan had the intent to sexually harass her but the way Elli reacted showed that he did cause her emotional distress, which was slight as she was fine within at least a day. Intent to sexually harass always falls by the way side if the victim reacts strongly to what happened and a reasonable person would know that what he/she did could cause the other person emotional distress. A reasonable person would know that saying "kapre phadkonga.." would cause someone distress, so if Elli had reacted strongly, actually causing her distress, then we might be able to make a case for sexual harassment..but not a very good one..

Andy's acts are the highest on the pendulum but I don't think Gauhar felt sexually harassed by Andy. He obviously caused her emotional distress but that would not allow for a sexual harassment case. There is also something also intentional infliction of emotional distress, that is what this claim would be.

I disagree with this. I also work in America and I don't think calling someone fat, kachara, unsuccessful would be classified as sexual harassment. There is nothing sexual about it. 😆

From all the business law classes I took in grad school, I can definitely say that Kushal's comments cannot be legally classified as lewd or obscene. Kushal's comments will be considered as offensive and if an employee or employer repeatedly passes offensive remarks to a colleague then that colleague can sue for harassment. But, definitely not sexual harassment.

Further, if an employer calls an obese employee fat and hampers his or her career advancement opportunities, then the obese person can file a law suit claiming work place weight discrimination.

@blackie : I did hear Tanisha saying, go take out your sexual frustration somewhere else. She wasn't mic'd properly, or BB chose not to air that. But it was a pretty aggressive comment for her to make, and would have some sort of retaliation expected.

IMO, the guy wasn't smart enough to make the stuff up. He was only reacting to the situation at hand. Doesn't justify his actions, but he was played by Tanisha and BB. They wanted him out, and he walked right into their hands,

Come on, Tanisha's bump was definitely intentional.

The first push was made in frustration as Kushal was putting all sorts of things in her box. The second bump was intentional and there was something sinister in her voice when she said, "Oops, sorry". And, she even admitted to Armaan on camera that she did it intentionally because Kushal was calling her all sorts of things.The third bump was not really intentional as she was enacting how she bumped into Kushal.

What irks me the most is that she admitted to Armaan on camera but on Saturday's episode her excuse was 'hosh kho baithi', something which fitted beautifully into Salman's story of glorifying Tanisha as a victim.

Its funny that people are denying that Tanisha's bump was intentional when there is proof. 😕Moreover, some are even twisting the transcript of Tanisha & Armaan's video and not acknowledging her remark that she did not slip but indeed bumped into Kushal.

Plus, the icing on the cake is that there is a post in this thread labeling Gaumata fans to those who consider Tanisha's bump as intentional. Now, that's ridiculous, especially when I am not her fan. So, you have to be Gauhar fan in order to bash Tanisha. 😕 And, this is not even bashing. We are merely stating our opinions and facts (the video).

@bold: Exactly...Kushal even said that in his interviews...he said she started getting personal...but many members of this forum just called it a lie...is it that only their favourites speak truth? 🤢
