Shiv is NOT misusing his power

I have been reading many posts which accuse Shiv of misusing power because the police said the Rajasthan Govt is filing the case aganist Jagya on behalf of Sanchi. Why are we assuming that Shiv is using his power to move the case forward ?

From what I understand little about the legal system, I have the below information from a lawyer

Charges can actually only be brought by the Govt not individuals in most legal systems. Its the State against the Individual Accused. It is based on Sanchi's complaint, but it is the State charging Jagya with a crime (incitement of suicide).

So, Shiv is not using his power in this case. Everything is going according to law.

When Sanchi was admitted with bleeding wound in the hospital and the doctor declared it is a suicide and not accident the case has become a medico legal case.
Doctors have to inform the police that it is a case of suicide.

A case has been filed by the govt against Sanchi because Suicide is a crime.

It was Sanchi while answering the police she gave Jagya as the reason behind her suicide.

It is upto the police to find investigate the case and see the validity of that statement given by Sanchi.

It was the police officer who decided to call ALL JAGYA'S WOMEN to strengthen his case.

It was not Shiv's decision to drag his wife.The police did it on behalf of the govt.

Shiv was treated differentially by the police officer because he was collector which most people do any ways the police officer has not made any concessions or bent the rules to favour Shiv.

If Bhairon is allowed to see Jagya in jail so is Shiv.

Shiv is definitely wrong when he allows his mother insult his wife and stays passive when accusations are hurled at his wife.Being angry with her is one thing and allowing his mother to insult and harrass his wife is another thing altogether.

Oh he is misusing is power. He wanted vengeance well before Saanchi's suicide attempt. That fact that he is using Jagya to recuse his sister from charges is killing two birds with one stone. All the police report to him. He is intentionally, consciously and actively falsifying Information by omission of salient facts. When those facts come to light in court he will have egg on his face and it will come to light that he has used his position as collector to bring these charges forwards despite the flimsyness of the charges. If he didn't misuse tis power, he could have let it be a straightforward case against his sister for suicide. But that is not the case. If he was truly just and not misusing his power then he should have recused himself from the investigations in his official capacity as Collector because of his personal involvement in the case. This personal involvement clouds his objectivity. Another collector or next in charge could have stood in for the police to report to.
Why is it that doctors are not allowed to operate on their own family. It's because they are too emotional and it could cost them dearly ( they could end up blaming themselves if things are not successful). Objectivity is lost when it becomes personal.

Similarly, as a Collector, in official capacity, he has no right to oversee the investigations because he can easily manipulate evidence and no one will question him because he is the boss.

If Shiv recused himself, I would agree with you that he was not misusing his power. But sadly the man is railroading the investigation to quench his thirst for revenge. I'm sure he must have even pushed for a fast track court with his influence. Other wise the wheels turn very slowly in India.

Actually, I just remembered in Saanchi's attempted rape case he told either the police who came to KB or Daddu that he didn't want to get too involved for propriety sake. He didn't want even an appearance of influence from him because the victims brother is the Collector.
So where is that objectivity now?

well railroading a process and bringing it to fast track court can hardly be called misusing his power!! Misusing his power can only be an allegation if he did something out of turn. By pushing a legitimate case forward and expediting it, it can be said he is ' taking advantage of his position'... but misusing his power definitely not.

Well he is being an accomplice because his sister gave her statement in his presence. There were many gaps and omissions in her statement and that is tantamount to misleading the law. Shiv could have set the record straight in capacity of brother but he chose to be silent. As a result he is misusing is power as Collector, because the Collector in him is aware of the brother in him who was witness to the falsified or manipulated statement.

This law does not make sense at all. If Jagya is charged with incitement to suicide then Sanchi should be charged too for attempting suicide. Whether Shiv is abusing his power, I am not sure but he sure is acting like an idiot

Actually Iam not bothered about Shiv misusing his power; I am bothered about him not using his power in such a scenario (power to think)
