Marry the mom. That's why I told you my family ka story coz below 18 unfortunately kuch hojata aunt ko bacho ka custody mere uncle ko nahi milta.
Aese nahi hota hai. Father in this case Abhimanyu mna krde that's a different case. But we know that Abhimanyu wants Abhir so at the moment AK dies Abhir pe first right Abhimanyu ka hoga na ki Abhinav ka.
But AK k hote huye na abhimanyu ka first right hai na Abhinav ka.
Maine ek point rkha tha that in case AK goes out of the picture somehow.
This is completely wrong.
There seems be confusion in this forum about the difference between biological and legal father.
Abhimanyu is simply the biological father, a glorified sperm donor. Abhinav is the legal guardian and father. If something happens to Akshara, the first right is Abhinav's.
It's not about who marries Abhir's mom.. This is about who is LEGALLY the father. It's Abhinav. On the birth certificate.
Abhimanyu can fight for custody on the grounds of biology but given that Abhir has stayed with Abhimanyu throughout his life and is his legal guardian, he will be given Abhir. After 18 he gets to choose.
Now it would come down to money and financial status too. That would be the only way to prove Abhimanyu would be better for Abhir. Now if AbhiN proves he can take care of the expenses, AbhiM won't have any chance.
The Courts don't just handover kids to biological parents. They see who's a better fit, who the child is attached too and growing up be given a familiar environment. Its not black or white 😆
Now during the proceedings the court will ask why AbhiM was kept away from his son and as soon as the truth comes out, AbhiM will never get Abhir lmao. Not in any lifetime, in any court.
I mean i know all this discussion is fun and games, but I see such nonsense about paternity fraud and bacha chor and all that crap about Akshnav, I just have to set the record straight.
Paternity fraud flies out of the window and becomes a complete moot point the moment spousal domestic abuse comes into the picture. No court would even consider it.
I still remember laughing in disbelief when AbhiM was screeching 'mera haq mera beta how could you do this to me' 😳🤔😆 like... what beta, what haq.. You think you can abuse the mother and get haq. Delusional much? Gaslighting much? Get help 😆
Edited to add : Apparently newbies have post limits so i can no longer quote or give replies for the time being... but wanted to comment on the post below which points out the correct legality.. hence adding this.
quoted from JustaFan13.
"Even after divorce, both parents have legal rights on the child. It's only after the custody case, the rights are either shared or given to a single parent based on the situation"
Correct and the parents as in the ones on the birth certificate. Not the biological parents.. The legal parents which have always been Akshara and Abhinav.
