Yesterday, someone was saying that Ak had no right to ask AbN to be father of her child when the real father was alive and he could only be his step father.


Once she got divorced, she had every right to do what she wanted with herself and her baby as well.

And you can have the same feeling for your real and adopted parents but you can't just disregard the real parent cause there is an adopted parent.


Not applicable here but adopted people sometimes DO decide to disregard their real parents especially in cases of abandonment.

No writing Abhinav's name in the birth certificate is what Akshara did wrong - legally.

About rights yes Abhinav have rights coz Akshara took the law in her hand in a way. Which Abhimanyu can prove very easily. Also, neither is Akshara denying the fact the baby is biologically Abhimanyu's and whatever reason, whoever was at fault he wasn't informed.

The case is on hold from both party but was filed.- will count as a proof of who is the biological father.


Unless in the adoption papers both Akshara and Abhimanyu signed and give legal rights to Abhinav. He has no rights on Abhir.


In case of something happening to Akshara, to win custody of Abhir he will have to prove how Abhimanyu isn't fit to raise Abhir and all.


As i said emotionally it's a different thing and i am not commenting on that.


I know this coz i have two cousins who are adopted.

One of my uncle married my aunt who has two kids from her previous marriage and recently when my cousin needed education loan to go abroad. He has to call his father to come and call in all legal documents my uncle wasn't required even though it's them who lives together and everything.

Law is law and ap father ji banoge doesn't work legally.

100%. Abhinav has all the rights on abhir ..socially and legally. When abhir was born akshu was divorced so the person she marries will automatically become abhirs father. Abhir is not an orphan who needed to be "adopted" by someone . AbhimNyu is only the biological father , not abhirs legal guardian. That's akshu and abhinav.

As an attorney myself, I can confirm Nav is the legal father of Abhir. Abhimanyu abandoned the child before he came in to this world when he divorced Askhara. Then she remarried and that’s how the right transferred to Nav.

Courts don’t look at the situation at the time of the divorce nor if Abhimanyu knew or not. Akshara can easily say she called Abhimanyu and told him and he didn’t want the child. Courts looks at evidence and not emotions.

Who said that ? Court does take actions on humanitarian grounds . All the circumstances are looked up at that led to a situation .

As per evidence this show has a lot of loop holes.

As a attorney you can say then writing Abhinav's name on birth certificate is wrong.

What Akshara could have done is made Abhinav the legal gaurdian of Abhir instead of faking birth certificate. In that case what you are saying will be valid.

In their case she started by breaking law herself.

She is no where denying that haan he is Abhimanyu's biological son basis which it was very easy for AbhiM to file a custody case. This itself is a complicated case.

I just put my comment keeping the emotional aspects of who is the best father, who is not, who abandoned who.


@bold this is the loop hole also there's no way to prove that Abhimanyu abandoned the child.


Again not saying or supporting what he did was right or wrong. But he has no clue of his child existence which was the talk also and second party didn't deny the claim.
