Exactly he took abhir without the consent of his guardian. As it stands right now abhi has no legal rights on abhir. Even if he believes he is the father he would still need to prove it in a court of law. You cannot Willy Nilly take someone’s kid. No that is not kidnapping. Abhinav is the legal father/ guardian. He has the legal rights on abhir. Abhimanyu does not. Also even on moral grounds how is this right. And you answered my question of abhinav had taken abhir you would have been screaming kidnapping. But abhi who has no legal rights, can take the child without informing the legal guardian because in his warped head he has been wronged.

Akshu's anger and hurt were valid BT now it's time to let it go and she has to find out what AB went through..! Abhi is overwhelmed by the fact that Akshu didn't tell him about Abhir all these years BT once his emotions settle down hope he may realize and regret his doings.!

Taking a kid without his parents permission is not permissible and illegal PERIOD. He can take him anywhere he wants be it his birthday or not as long as he informs the parents where he’s taking him. His parents can file a police complaint and police will take this as a kidnapping case.

This is not about who has custody or not/who is the biological father and who is not, Abhimanyu will never be able to take Abhir without Akshara’s permission unless he gets full custody which will never happen.
