right...

only kunal gets punished for adultery..indian law always treats wonen as innocent in adultery cases..so rajdeep can send kunal to jail...but nandni not going to get punished..

Everyone knows it that only Kunal will be punished.

If Rajdeep proves her characterless then society will do the rest. Don't underestimate the societal bashing.

And yes, if Rajdeep wins the case then he will come out as a victim and not as an abuser. Cases are won on testimonies. Kunal's testimony will have 0 value now.

That's right but for IPC, marital rape is a very grey area. Since it's hard to prove consent in marriage for everytime the couple have sex.

The legal complications are huge and there have been a lot of cases where the man have been falsely accused in it.

Marital rape is grey area and in IPC, it's not a punishable offence.

Are couple going to have a written consent everytime they are going to have sex since one needs to prove that there was indeed no consent in marriage before the sexual act this particular time.

I think person was trying to talk about emotional trauma in both.

Rape is not just physical, it's effects are emotional trauma since the body was violated without consent and that has implication on mind and heart. Trauma is beacuse of the violation of someone.

Cheating also leads to emotional trauma especially in marriage. Since the person feels violated too. The implication of it is also on mind and heart and sometimes in body too as victim may feel used by the cheater.

Emltional implication of both on the victim are more or less very similar. Victims can move on from both but it takes a lot of time to recover from that.

rape definition: 1. to force someone to have sex when they are unwilling, using violence or threatening behaviour

it doesn't matter if it is not punishable offence.Its still called rape and Rajdeep is a rapist . Looks like people here only sympathies with women whose husband cheats them .Not rape or domestic violence victims .
