Chapter 27:
Pathak looked up from the file he was reading when he heard a knock on his door.
"Ah Kabir, Rachna, please come in. Have a seat."
Kabir and Rachna took their seats, facing Pathak who was sitting on the other side of the desk.
"Thank you for working so quickly in all this Pathak. I really appreciate it."
"It's my job Kabir. Now, I called you here today to tell you that the court hearing is scheduled for the day after tomorrow. I'm sure that you are already aware of this but Mayank is being represented by Gayatri Tripathi's lawyer, Madhav Karanjkar. Rachna, a fair warning to you; Karanjkar is a very shrewd guy. Are you sure you feel okay about all this? I don't like to sugar-coat things and the reality is that the next few days in court will be very tough for you. Not only is Mayank going to be there, but his lawyer is going to ask you very personal and troubling questions. He's going to try to get into your head. I just want to make sure that you are fully aware of what you are stepping into."
"I...I guess...I mean...I think I'm ready." Rachna chewed her bottom lip, scared by the lawyer's words.
Kabir reassuringly squeezed Rachna's hand. "Pathak, you're not helping. Chill out a bit."
"I can be nice right now Kabir, but that would be deceitful on my part. I've dealt with harassment cases before and most often, it is the victim who gets scared and frightened by the questioning of the defense lawyer. We need to make sure that Rachna is adequately prepared to answer those disturbing questions. We have strong evidences in our favor, especially the medical report, but ultimately it is going to be the victim's testimony that will hold a lot of weight. If it's okay with you, then I would like to do a practice run with Rachna to give you a taste of the kind of stuff you might face on the day of the actual hearing."
"Rachna, is that oka..."
A disturbance outside of Pathak's office interrupted Kabir. Looking out the glass door of Pathak's cabin, Kabir saw a woman fighting with Pathak's secretary to force her way into the room; the woman was none other than Gayatri Tripathi. Pathak quickly made the same observation as Kabir. He jumped out of his chair and walked out to put an end to the commotion. As soon as Pathak stepped in front of Gayatri, she looked at him with her menacing eyes. Pathak quietly led her into a private conference room and shut the door behind him.
"You two-timing bas***d! How dare you double cross me?! You switched those divorce papers on purpose! Do you know who I am? I'll have your license revoked within minutes and you'll never be able to practice law again!"
Pathak patiently listened to Gayatri's furious outburst. When she finally quieted down, he spoke up in his most professional voice. "Ms. Gayatri Tripathi. I urge you, by all means to go and file a complaint against me. But on what grounds do you plan to have my license revoked? For protecting my client's welfare? For not accepting your bribe to perform illegal actions? For not tricking a husband and wife into a divorce that they were both unaware of and unwilling to go through? Please, do specify which of these acts of mine is criminal enough for me to get my license revoked."
"Oh bullsh*t! Just cut the cr*p and tell me how much it's going to take for you to sort out this harassment matter as quickly as possible. Name your price."
"If you are here to bribe me, I assure you that I can have security come in and kick you out of my office. Otherwise, if you would like to save whatever dignity you have left after creating a ruckus in my office, then you can leave quietly on your own."
"Are you threatening me? How dare you threaten me?! I'll make sure you're ruined Pathak! I'll make sure of it!"
Gayatri stomped towards the door, as she heard Pathak call out behind her.
"Do give it your all Gayatri ji, but just remember that I had some CCTV cameras just recently installed in this conference room for security purposes. Oh and don't let the door hit you on your way out."

Pathak walked back into his cabin.
"I'm so sorry Kabir and Rachna to keep you waiting like this; just a pesky little problem that I had to take care of. Anyways, back to what we were discussing."
"Pathak, what did she want? Why was she here?"
"For obvious reasons Kabir, but don't worry about her. She can't cause any problems for us."
"You know her Pathak. She can very well manipulate this situation right now. We have to be very wary of her."
"Don't worry about it Kabir. I've got it all under control. Right now the most important thing is to make sure that Rachna is prepared. Rachna, can we do a practice run with some questions?"
Nodding her head tentatively, Rachna agreed.
"Okay great. Why don't we move into the conference room then, it will be more private."

Tears flowed down Rachna's cheeks as she squeezed her eyes shut and grabbed onto the edge of the table for support. She was shivering with fear, having been reminded of the traumatic experiences that she had been trying to move past.
"Stop it. Just stop it!" She screamed. Kabir immediately rushed to her side and held her in a tight embrace.
"Shhh, it's okay Rachna. Calm down."
In a barely audible voice, Rachna whispered into Kabir's ear. "I don't want to do this. I can't do this."
Running his hands comfortingly through her hair, Kabir nodded. "Okay, okay. Relax. Let's just go home for now."
Picking up Rachna's purse, Kabir began leading Rachna out of the room. "Pathak, I'll call you later."

Kabir stood in the balcony, leaning his elbows against the railing and pressing his forehead against his hand, trying to get rid of the throbbing headache. He felt his eyes getting moist as he remembered how Rachna was shaking with fear and how she had broken down so terribly. Feeling a slight pressure on his shoulder, Kabir wiped his eyes quickly and looked behind him.
"Is everything okay bhai?"
Looking back out at the city lit up in front of him, Kabir shook his head is disagreement. "No Karan, it's not. As much as that bas***d deserves to go to jail, I can't see Rachna suffer like this. Pathak did a practice run of the types of questions that she might be asked in court and Rachna's reaction was just so hard for me to see. I don't want to see her like that ever again."
"I can only imagine how difficult it must be for bhabhi, but it's the only way to get justice. You're not going to take back the case right?"
Before Kabir could answer, a firm voice called out from the background.
"No Karan. We're not going to take this case back. I've suffered through all this for too long; it's high time that he get the punishment for his actions and crimes. Why should I be the one to suffer when I didn't make any mistakes? Kabir, we are not going to back out now. I want to go through with this."

"I'm just going to go get some water. Do you need anything bhabhi?"
Shaking her head, Rachna looked straight up ahead. "No Karan. I'm fine."
"Okay, I'll be right back then."
Just as Karan left the court room, Sneha squeezed Rachna's hand in support as she took a seat on the bench next to her niece.
"Gunjan was insisting on coming, but I forced her to stay home with Akash. It's not a good environment for her to be in right now."
"You're right mausi ji. It's good that she's not here." Rachna twisted her hands and bit her lower lip nervously.
"It's okay Rachna. We have the truth on our side; just be strong. By the way, where's Kabir?
Looking across the room, Rachna pointed towards the table where Kabir was sitting with Pathak and his assistant, deep in discussion. "He's just discussing some last minute things with Pathak ji."
Kabir turned around and looked back towards Rachna right then. Her eyes met his and it seemed as though the world stopped momentarily. It seemed as though they were the only two people in the room; they talked with their eyes.
"It'll be okay."
"I hope so, but I'm really nervous."
"Don't be. I'm here for you."
"Promise?"
"Cross my heart."
They broke their eye contact as they each heard the noise of people standing up from their chairs; the judge had arrived. Settling into his seat, the judge ordered the proceedings to start. Kabir walked back from the lawyer's table into the audience and took a seat next to Rachna. Interlocking his finger with hers, he kissed the back of her hand discretely. She turned her head to look at him; he nodded his head in encouragement. She blinked her eyes slowly to let him know that she was okay. Rachna looked back to the front of the court room and turned her attention to Pathak. Karan slipped into his seat, next to Kabir, just as the lawyer began to speak.
As Pathak made his opening statements, Kabir glanced over to the opposite side of the room, where Gayatri was sitting at the table with her lawyer, Madhav Karanjkar, who was intently listening to his opposition's arguments and points. Gayatri looked towards Kabir with a furious glare; he stared back with equal intensity to show his unwavering resolve. Meanwhile, Mayank stood in the witness box on the far side of the room, looking quite disheveled from spending the past few days in jail. He stared out at the court room with a rather disinterested expression, feeling confident that he would be able to get out of this case scot-free.
As Pathak took his seat after finishing up his opening points, the defense lawyer stood and presented his arguments.
"This seems to be quite an interesting case Your Honour. My client, Mayank Tiwari, is being tried in court for supposedly molesting Mrs. Rachna Kabir Tripathi on the afternoon of September 26th, a day when my client was not even anywhere remotely close to Mumbai, where the reported event occurred. For me it's a cut and dry case Your Honour. My client is falsely being accused of sexually harassing Mrs. Rachna Kabir Tripathi. In fact, it seems like this entire court case is just a ploy to actually harass my own client for some personal enmities. The prosecution appears to be taking advantage of the fact that the Indian legal system takes sexual harassment and molestation charges very seriously, but it's a bit disconcerting to see that people like Mrs. Rachna Kabir Tripathi take advantage of these laws to trap innocent men like my own client to get some personal hostilities out of the way. I will be proving this to you over the course of this trial. That's all Your Honour."
Rachna's face burned with anger. She tightened her fingers around Kabir's hand. Kabir looked at Rachna and moved close to her to whisper into her ear.
"Relax Rachna. Don't get worked up. He's going to twist all this to his convenience, but don't let him get to you."
Rachna nodded slowly with understanding and loosened her grip on Kabir's hand.
Pathak began his round of cross-examination by questioning Mayank. "So Mr. Mayank Tiwari, can you tell us what you do for a living?"
"I'm a doctor, an intern at Fortis Hospital in Gurgaon."
"Impressive. So where do you live then?"
"Obviously I live in Delhi since I work in Gurgaon."
"Of course, of course. Does your family live with you in Delhi as well then?"
Mayank shifted uncomfortably. "My family? Uh...no. They don't."
"So where do they live then Mr. Mayank?"
"Mumbai. My family lives in Mumbai."
"Ah I see. Do you love you family Mr. Mayank?"
"What? What kind of a question is that?!"
"A very straight-forward one; do you or do you not love your family?"
"Yes, of course I love my family."
"Good good. I'm glad to hear that. Well then, you must come to Mumbai to visit them from time to time, no?"
"Yeah, I do."
"Ok, so when was the last time you visited?"
Mayank paused. "I...I...I don't...don't remember the exact date. Uh...it was a few months back."
Pathak raised his eye brows as her turned to the judge. "Point to be noted Your Honour. The accused doesn't remember when he was last in Mumbai."
Karanjkar stood up from his seat. "Objection Your Honour! These questions have nothing to do with the case at hand!"
"Overruled! Mr. Pathak, you may continue with your questioning."
Turning his attention back to Mayank, Pathak began. "Thank you Your Honour. So Mr. Mayank, can you tell me when you last came to Mumbai please?"
"I just told you. It was a few months ago. I...I don't remember the exact date."
"So unfortunate that is. Well, that's okay. Why don't I remind you then?"
Pathak grabbed some documents from his table and handed them to the judge, who studied them closely.
"Your Honour these are the flight details of Mr. Mayank's latest bookings, which clearly indicate that he last travelled to Mumbai on September 25th, the day prior to the occurrence of the reported molestation."
Looking at Mayank with a bemused expression, Pathak continued his examination. "Wow Mr. Mayank, it seems like you have quite a memory problem. You don't remember yourself that you last travelled to Mumbai just three weeks ago? In fact, you have been here since then, haven't you? But a few minutes ago you mentioned that you are an intern at Fortis Hospital in Gurgaon. How did you manage to arrange such a long holiday off from work? From my general conception, medical interns rarely get any time off from work."
Mayank was clearly beginning to get flustered now. "I...I...those flight details are fake! I just came to Mumbai three days ago for a quick trip. I was scheduled to leave for Delhi when you guys threw this case on me and got me arrested!"
"Point to be noted Your Honour. Mr. Mayank, who just claimed to not remember the last time he had travelled to Mumbai, just gave quite a detailed answer of his travels. That's all Your Honor. Your witness Karanjkar."
Pathak took his seat, as Karanjkar stood up to begin his round of questioning.
"I'd like to call Ms. Gayatri Tripathi to the witness box Your Honour."
"Permission granted. Ms. Gayatri Tripathi, please make your way to the witness box."
Gayatri stood up and walked to the witness box.
"Gayatri ji, can you please tell the court how long you have known Mr. Mayank Tiwari?"
"Since he was a young child. He's the son of one of my close business associates. In fact, he's like a son to me."
"Okay, so you would say that you share a close, nurturing relationship with him? Well, then can you tell us a bit about Mayank and his personality?"
"He's a simple straight-forward boy. He's always been good in his studies, a topper in school and college. And now he's training to become a top doctor. Mayank has taken his studies very seriously, but he's always put his family first. Overall, he's a very cultured and good-natured boy. I don't know why some people are hell-bent on maligning his name now."
Gayatri emphasized her last sentence as she glared at Rachna.
"Point to be noted Your Honour. My client has always been a high-achieving scholar, an ideal son, and a good citizen overall. You'll also see from these documents that he has no past criminal records or complaints against him. That's all Your Honour; your witness Pathak."
"Ms. Gayatri Tripathi. It seems that you've known Mr. Mayank Tiwari in quite...quite a close fashion let's say. Impressive though that you can so confidently attest to the character certificate of someone else's child. Nowadays it's tough for parents to even talk about their own children so confidently. Anyways, I'm curious to know, do you have any children of your own?"
"Yes. Two of them; my sons."
"My oh my, two sons! Can we have their names please?"
"Objection Your Honour! Prosecution is digressing into unrelated matters."
"Sustained. Pathak, keep your questions related to the case."
"Sure Your Honour. But actually this is quite relevant to the case. So, Ms. Gayatri Tripathi, can you please tell the court the names of your two sons?"
Making a stern, irritated expression, Gayatri responded curtly. "Kabir and Karan."
"Full names please Gayatri ji."
"Kabir Prakash Tripathi and Karan Raj Tripathi."
"Ah, so Mr. Kabir Tripathi, Mrs. Rachna Kabir Tripathi's husband, is your son. That would make Mrs. Rachna Kabir Tripathi your daughter-in-law. Is that correct?"
Gayatri rolled her eyes. "Yes."
"Point to be noted Your Honour. My client, Mrs. Rachna Kabir Tripathi, is Ms. Gayatri Tripathi's son's wife, more easily termed her daughter-in-law. Thank you for your cooperation Gayatri ji. That's all Your Honour; your witness Karanjkar."
As Gayatri left the witness box, Karanjkar called for his next witness. "Your Honour, I'd like to call up Mrs. Rachna Kabir Tripathi to the witness box."
"Permission granted. Mrs. Rachna Kabir Tripathi, please come up."
Rachna sharply held her breath. Kabir squeezed her hand and placed a reassuring kiss on her forehead.
"It's okay Rachna. Go on and remember, don't let him get to you. Just answer the questions straight-forwardly."
Rachna nodded meekly as she stood up and walked into the witness stand, where Karanjkar immediately began his questioning.
"Can I have your name please?"
"Rrrachna," she answered shakily.
"Your full name please and speak a bit louder so everyone can hear you."
Rachna took a deep breath to calm herself down. "Rachna Kabir Tripathi," she stated clearly.
"Okay Mrs. Rachna Kabir Tripathi, can you tell me about what happened on the afternoon of September 25th? And please be as detailed as possible for our jury members and the judge."
