This is all fictional no doubt...however, if Jodha was indeed guilty, that would have been his verdict -> execution (I realize that the amount of investigation that went into accusing Jodha was minimal and that Jalal was being very strong-headed about it, BUT and a big BUT, in yesteryears it was not really a hard task framing and having someone else executed for it - even a royal!)
