'No maintenance if partner knew man is already married'

NEW DELHI: While the Supreme Court in its landmark judgment broadened the scope for NEW DELHI: While the Supreme Court in its landmark judgment broadened the scope for women to claim maintenance, even in a live-in relationship, a trial court has said the interpretation would not be applicable when the woman entered into a relationship knowing that the man is married.

"This judgment is applicable to those persons who have live-in relations, and the apex court has equated their status to be as of husband and wife having some rights and duties but it is not applicable when a woman already knew that the person is married. Then the provision under Section 125 CrPC (maintenance) is not applicable and the woman is not entitled to any maintenance," the additional sessions judge said.

LMAO! Hopefully the CVs are aware of this otherwise Gauri is bound to make such a claim 😛Thanks for alarming us though...at least we can fire back if Gauri returns with her additional nonsense!

Gauri cannot claim any maintenance in any sense cvs will be showing a maha blunder if they do so at same time her abortion cvs themselves have confirmed with time A seven months pregnant lady cannot work in hospital like that so she cannot even have a child too so cvs can only show her coming back for forgiveness only

Some of us are behaving as if Gauri is indeed returning! LOL!

Gauri can surely not make such claims for maintainence anymore. But I disagree that CVs indirectly confirmed her abortion by showing her working at the hospital.

Notice they did not "show her" working there! Who knows if it was that Gauri at the hospital or some other Dr. Gauri Singh (namesake)??

And sometimes some workaholic women do keep working even till later stages of pregnancy. Gauri is a doctor whose job mostly involves sitting (unless she has to perform operations). TV actress Smriti Irani had kept shooting even till her 9th month when she was doing Kyunki! And acting is an even more demanding job! (She herself confirmed this on TV at Vir Sanghvi's talk show on Star World some years ago)

So maybe even if it is the same Gauri, she might have been working there.

Not actually showing Gauri meeting Jagya has given CVs many options to handle that character in case they want to bring her back in future and throw up new surprises/shocks for audience/BV characters.

They are yet to show anything in regard to her so we cannot draw conclusions.

I hope this time around Gauri checks laws properly before slapping any lawsuit on Jagya unlike she did before marrying him.

BTW I don't understand why CVs cannot replace Gauri if they could replace Anandi herself! Why keep that angle unresolved and bring additional female interests for Jagya in form of BOTH Ganga and Saanchi?

(Not that I object to Jagya-Ganga match or Jagya's right to move on!)

But it will be crazy to see three women surrounding Jagya if Gauri also returns! Too much drama will ensue! (While Ganga will handle it with tact, that Sanchi has every chance of going psycho and her condition will affect Anandi's life at Shekhars' too!)

Let's see what happens.

what about mental stress and how she has to sit only she has to check her patients too Thats carelessness to show such negligence and she has super speed as well she ran away so soon behind back door indeed she is a super woman and at least her parents are not that sincere to her had she got a child they would have found ways to tell J so lets see what cvs do here they can anything even you can be wrong even i can be

cvs wanted to close Jagaya Gauri chapter for a long time as this is not right so in my view they are just doing that otherwise replacement is not a issue for them they are only increasing their distances

J did not have a job. In a divorce where one spouse makes he money , that person has to pay

Look there is nothing to laugh about that. We and characters in the serial concluded that Gauri did not want to see Jagya so she did not come out to meet him.

Whereas in reality Gauri was never shown at all! We were not shown that she did not want to see him that's why she did not come out. We are only making a deduction of our own own on assessing her lack of response.

What I mooted was just a possibility. I did not say it must surely be so.

There is nothing ROFLing in considering every possibility.

Yes there's a lot of stress and all but some women do work and we've plenty of examples of that in real life. So we cannot conclude that she aborted the child - until there is anything that has been shown to us.

There are lot of possibilities and impossibilities for CVs to handle Gauri's character. As we both agreed on - let's see.

BTW, the other member is right. In their relationship Gauri was the earning member whereas Jaggu was jobless or dependent on financial aid from Singhs (except for some patches of time when he did work and earned himself too). So she does not even have to claim maintainence.

Gauri's parents were weaklings. It is possible that Gauri forbade them from communicating to Jagya about the child or probably asked them to quit interfering in her life (since their advice had ruined her relation with Jags). It's not necessary that if she indeed kept the child then her parents would have informed Singhs or Jagya!

Who knows? Perhaps Gauri has renounced everyone and lives like a single mother, devoted only to her child and her profession - developing an anathema for marriage after all the panga she went through since childhood? Or who knows if she has remarried or been supported by some other man?

There is nothing we can say about a character that was just made to disapear and never tackled again.

When Gauri refused to meet Jagya, the first thought came to my mind is, she is heavily pregnant and she doesn't want Jagya to see her in that state. And probably she is under the impression that Jagya being in Jaitser means Jagya is back to Anandi. Nothing was shown till not to think in that line. Jagya's letter also doesn't talk anything about Anandi. So for Gauri, it is like Jagya left her to go back to Anandi. She might have got very angry when Jagya came to meet her in hospital(NOTE: He didn't go to Gauri's house) and refused to meet him. Probably to give him a taste of his medicine(Gauri might have waited for him for months)... This is all my imagination. But it is still a possibility in the show. CVs can show many dramatic scenes with Gauri's re-entry.
