When a woman is married in India, her households changes socially and legaly. Since A was married to J, and was his legal wife before yesterday, it does not make any difference if her husband falls in adultary.If husband falls in adultry, and shout every day at woman that I dont consider you as my wife, Should wife leave her home and go?
The basic difference you are not getting is : After marriage , its not only Jagya's house, But its Anandi's house as well. There exsits no body who can claim this house is not of Aanandi, and there is no relation of Aanandi' with Sumitra and Other Family members. Aanandi has power even to take her share in the house.
So first thing : This is not only Jagya's house,The moment their child marriage became legal, this house became permanent home of Aanandi's . Her Voter's id card would hold permanent address of this property, after she turns 18. So she should not move out from her house just because husband is in adultry..
Second: Even after divorce: because she is not re-married yet, She can claim maintanence form husband, or in-laws. and as Mr jagya's share is there in the house, it still gives right of 50% on that share OR else J has to provide her maintanence, so that she can live a equal status life like J.
Third : No matter Jagya marry to some other girl, even if A is not married, J has to provide maintanence for life time to her.
Fourth: No matter how much J shout Gauri is his wife, She still can not claim any thing from him or his family as she is not a legal wife.
