The Hindi soaps universe is governed by a very different law of physics...😆 that I will never understand. so, stands to reason that they have their own Hindi Drama Marriage Act circa 1990s...

But it's an interesting question - I also read that in any case, petitions for divroce cannot be filed until after a year has gone by.

I've often wondered what if you're Hindu, but want to be governed by civil laws (which are more liberal - you can divorce on grounds of mutual incompatibility etc) ?
Maybe you sign a different marriage certificate...

Arti did not lie so technically , she cannot be held liable.
If they did want divorce, then ,
Arti could state that, she was not informed about this and the scindia's (spelling) would have to agree that they never spoke to her regarding this issue. They just assumed she was a widow based on the statements given to them by her ex-inlaws

So technically she wont be held responsible.

Now morally, what their in laws did was wrong.
They should have been clear about this from the start.

If only my mom could see me now. Who thought a show would make us wanna study🤣

How would intermarriages work?🤔 Like say for example Hindu-Muslim marriage. Which law code would you follow?

Even I've heard you can't get divorced until a year's passed (again going by what I've read😆) cuz I think it's so that people don't take something like marriage lightly but there are I think certain exceptions to this? So in this case, would Yash and Aarti have to stay together for a year and then file for divorce or would it be given earlier cuz they'd say it's fraud?🤔 Of course, I don't think they'd even consider it because they both want a mom/dad for their kids but just curious😆

@bold: LMFAO 🤣🤣that is so freaking true! You can never try to understand the law in Indian soaps because they have to add their own twist and drama to every little clause 😆. But I have to say I am absolutely LOVING all this law research, it can only be our curiosity that will lead us to do research on a show!

Either way though, I am sure the reveal of Aarti being a divorcee will bring a lot of drama, but I don't think it will get to the point where either of them is even going to consider a divorce. Considering they both married for their children's sake, and I am sure by that time the kids will totally be in love with their new parents, they aren't going to uproot them like this. Yash, for the first time, will end up taking this decision in his hand and will stand by Aarti at what will probably one of the worst fixes of her life. I think this is the reason they're emphasizing the whole kids deal so much, and not only that but this revelation will be the turning point of Aarti and Yash's relationship!

i know hiding that your married is legally wrong but didn't know that it went the same for divorced/widowed... but ya morally it is wrong-no matter what your reasons are!

interesting discussion...
yes, it's wrong to hide the divorcee status of aarti (i don't know why i cringe at the term 'moral' - it's constructed in so many different ways nowadays)... but i don't have knowledge of the legal grounds... i doubt the makers of the show themselves have that much idea about the law... i for one am not comfortable with them going this route even if it is to create drama... let's see how they handle it though...

Great discussion and very valid points from everyone.

Hiding the correct marital status is definitely not a punishable crime (unless of course she is still married). But it could be grounds for further legal action. As discussed earlier by some, it could be grounds for a divorce later saying that there was deliberate deceit.

Had it been any other country, it could also be grounds for Suing. The Scindia's could sue the Dubey's for intentionally misleading them. Given the fact that they are projecting this whole marriage as a great social service act of remarriage of a widow and trying to claim Social brownie points, one can only imagine their anger when the truth comes out.

But we know both the above are not going to happen as this is an Indian Soap.
