I guess I wasn't clear. It is not ludicrous exactly. For kidnapping, you have to prove intent. You need to prove that Abhira was malicious and intended to harm the kid for it to qualify as 'kidnapping.' Intent doesn't play as major a role unless the case involves ransom or coercion, but it cannot be wholly ignored.
You cannot simply accuse someone of kidnapping. You need to prove a lot of things before the court can charge them. Many cases have been overturned because they weren't able to prove intent to harm or defraud, etc.
If you cannot, then it's a false claim. You can seek damages in court for false claims, which is also why I added that she needs a good attorney.

1 Did Abhira know that it wasn't her child? Yes
2 Was the child in Ruhi's custody when he was kidnapped? Yes
3 Was Abhira depressed? No

Father's consent doesn't override Ruhi's claim on her child, Rohit consented but his consent was deceptive making his a culprit of cheating along with Armaan
The truth was revealed in presence of many witnesses and Abhira, before kidnapping Abhira knew that the child wasn't hers, she can't claim that people deceived her or Rohit consented to anything after truth revelation
Depression or emotional trauma - Doesn't work in serious cases like abduction, the legal defense requires complete unsoundness of mind, depression is no defense for crimes
And in the show, they never said Abhira was depressed
Intent works and most likely the case will be transferred to a civil court for custody of Daksh and further remedies but there can be no case on Ruhi because she is biological mother and Abhira did kidnap her child, there's no ground for defamation because the act was committed even though the intention was not kidnapping
