Actress Karisma Kapoor's husband Sanjay Kapur filed a case against her on August 5 for acquiring a passport for their daughter, Samaira, without his consent and trying to take the child away from him to US. The Delhi High Court restrained Karisma from using the passport and said she could not take her baby out the country. Karisma filed her reply, saying her husband's petition was misguiding. Her reply also said that she and her husband have been living separately since the birth of their daughter five months ago and Sanjay never bothered to come and meet the child. She also alledged that he has not paid a single penny towards the child's maintenance and has totally neglected her and the child. She also said that she has been taking care of the child and she is Samaira's guardian. Karisma said she had the right to apply for her daughter's passport since she has her physical custody and care. In reply to this stand Sanjay filed his rejoinder saying that Karisma is trying to mislead the Court and is confusing the Court with matters which are beyond the Court's jurisdiction. He said that the petition is for deciding whether the passport acquired by Karisma is illegal and also for an injunction to restrain Karisma from taking the child out of the country. Karisma is trying to convert it into a custody battle. Kapur also alledged that Karisma is lying by saying that he didn't visit the child. He said that he had gone to Bombay to visit the child however Karisma didn't allow him to meet her. He also said in his rejoinder that he has paid Karisma's credit card bills and other expenses and even today has been paying the same. He has attached copies of credit card statemnt to his rejoinder. The matter has been posted for hearing after a week.
