The last time a marital rape case was filed, some minister said that in India, marriage is sacred, a sacrament. They follow such Indian social norms which are outdated and decriminalize things that should be criminalized. The victims file such cases under domestic violence and not sexual assault. The fact that a law needs to be based on some tradition or values makes it illogical. A crime is a crime no matter it is committed before or after marriage or in any other circumstances.

According to POSCO act, age of consent is 18. So if 2 ppl below 18 hv consensualll sex,still it is treated as RAPE !!

While marital rape shouldn't be decriminalized, you have to admit that this is a very tricky and sensitive matter.

How can you prove that it was rape? It could be role-playing, it could be consensual, or a woman may simply manipulate evidence if she wished. I'm not saying a woman would but it is possible.

So, how do you prove it?

In a country like India, marital rape is common, especially in rural areas. That can't be denied.

Having said that, let's also look at the moral and societal implication here.

If a woman says no, it's a no. That's how it should be.

But if a man says no, it should also be a no.

Studies have shown that reverse pressure is also equally true especially in urban areas, where if a woman wants sex and a man doesn't want to - either something is wrong with him or he's taunted to be less of a man.

Why does this double standard exist?

Twinkle joked about Indian men lasting for only 2 minutes. But if Akshay had joked about a woman getting exhausted in 2 mins; feminists and the brigade would have been out labeling him as a male chauvinist pig - using their favorite term: patriarchal oppression.

Marital rape happens both ways. Men generally force themselves on the woman using violent measures; women usually manipulate men or use passive-aggressive tactics. That's the only difference.

Yes marital rape is a criminal offense so is any form of violence against women So it's hypocrisy of her to speak up like this when she herself works with the guy who supposedly slapped her

I personally feel "Rape under promise of marriage" should be decriminalized. It is wasting time of everyone. It is NOT rape.

Women should learn to take responsibility for their own actions. Enough of playing victim always. Even Adultery by women is not considered a crime by law but men is considered a crime. These Biased laws actually try to show that women are brainless n hold zero responsibility or accountability for their actions.

Most Fake rape cases fall under "Promise of marriage" clause. Instead of punishing the guy for a failed relationship, the families should teach their daughters not to indulge in premarital sex or live in relations if they are incapable of handling break ups.

Decriminalizing it can remove the bulk of such cases, free up the system for Genuine Rape cases and process the procedure faster. That way REAL victims can get justice faster.

Totally agree...if the people are of legal age , they should take responsibilities for their actions...otherwise men should also be allowed to file for rape under promise of marriage...I mean ye achha hai...ki breakup ke baad accuse the guy of something as serious as rape...jaise khud ka dimaag nahi hai...how does sex with consent turn into rape as soon as they decide not to get married...this law is totally and utterly useless...just set there waiting to be abused
