I'm not sure I understand what you're trying to say. Everyone below the age of 18 is already covered under POCSO, talking specifically about India. 18 and above, if it is consensual, it shouldn't ideally attract a criminal charge.

You were talking about consensual sex shouldn't have any penalty .

If a 17 year old has consensual sex with an adult and if this is reported by the parents in police for any reason what so ever, then the case falls under POCSO and the adult is liable to be punished, even the teenage guy can be punished if a complaint is made against him. Consent of a below 18 year old isn't considered valid by court in such cases even when it should be considered since consent has been there

Laws can be really twisted, atleast IPC is.

There was a movie Tere Sang on teenage pregnancy and law around it. The court condemned the boy for being irresponsible to have got the girl pregnant, even though the sex between them was completely consensual.

I said no consenting ADULTS should be penalized. Just to be clear, I am not advocating all consensual sex to be decriminalized.

I don't watch this show regularly so I don't know if Nandini's divorce has been finalised yet.

In case it hasn't, he can be punished under section 497.
