Most wives just get divorce from the cheating partners & want to end the relationship in all ways as soon as possible.
There is hardly anyone who takes any further legal action since legal procedures are exhaustive & prolonged which only add to the suffering of the victim.

I understand the emotions behind wanting to see Kunal be punished in some form or the other. I get that. But if we look at it in a technical aspect... then Kunal's legal punishment won't really be Mauli's victory but Rajdeep's unfair victory. Which is why I asked what if it was another single man in place of Kunal. Does Rajdeep deserve that victory even then?

Of course, I want the CVs to show Kunal and Nandini face consequences in some other way... just not in the legal way where Rajdeep gets to have the upperhand... because that wouldn't be true justice.

Exactly! And this law is not applicable on women cheaters. Husbands usually use this provision in those cases where wives collude with their lovers to physically harass or steal from their husbands. So in addition to charges of theft, this provision can be used to give additional punishment.
The act of adultery is anyways considered as valid grounds for divorce. So I believe that should suffice.

I think he can file a case as nandini and him are still not divorced. And also, while cheating he hasn't wronged rajdeep in any way but nandini has, just like mauli lets say rajdeep was an innocent person then he would also have been devastated after the cheating and indian law is framed in such a way that a husband can file an adultery case on the man and not his wife. I am saying this just from whatever I have read on social media about this.
And I don't mind legal punishment because mental betrayal is same as physical, it's just like violence just that now no one can see how deeply it is affecting you. And physical wounds heal overtime, mental healing may take a long long time or sometimes it takes forever..

Section 497 of the Indian Penal Code deals with Adultery. As per the Indian law, a woman cannot be punished for the offence of adultery. Only a man who has consensual sexual intercourse with the wife of another man without his consent can be punished under this offense in India. If someone "lives in adultery", the partner can file for divorce.[1]

So Nandini will never be in jail and won't be punished too, but Kunal can and I want him to suffer. Though KuNan(sick) are equally wrong, I feel Kunal is more on the wrong side than Nandini. Though this no way justifies EMA but atleast she a past, that made her seek love but janaab ka kya kehna? I am waiting to see how he explains to others on why he did EMA lol

I think recently the court has said that people who have applied for divorce can be in a new relationship . I read it randomly so I don't remember exactly, but I don't think in such a case there can be any legal punishment.

No .This law should exist and should expand to include woman also .now existing law cant punish rondini .it can punish only kunal.

if u want to have sex have it after divorce or with u r wife or husband consent .no one stops you .we r not animals in stone age where there is no marriage system and any one can go with any one at any point of time .So they made these laws.

Even kunal is single unmarried he needs to wait to have sex till Rondini is divorced .if he is a animal and can't wait he need to be punished or he can go to prostitute to satisfy his sex urges

Then Kunal can they had sex !
But why to punish him alone !
Kundini were patners so must be punished if not none should be punished
Let them continue "their masala lust story "
