Indian Justice System vs American Justice System

Let me make two points VERY clear before I move on:
1. If the moderators of this section do not seem this topic fits Bollywood (even though I'm trying to relate it here), then my apologies and please do move it to the appropriate section.


2. With the latest controversies from members about NRIs and stuff, I just want to make it clear that I do NOT hate my country. I stand proud to be an Indian more than American (being born and raised in America). My heart is always for India. But just like any country, this is just a flaw I see in India.

So, I don't know whether the Debate Mansion is the appropriate section to write this in.

I also don't know how many of you follow the news (for those that live in America) and how many of you watch American Football. I am a huge New England Patriots fan and therefore this news kind of makes me sad.


But you (and by 'you' I don't mean YOU, I mean the guy Aaron Hernandaz)...
- You are a pro athlete.
- You are one of the best on your team.
- You play for one of the greatest NFL teams, if not the greatest.
- You play under one of the best coaches and one of the best quarterbacks.
- You have a beautiful small young kid.
- You, yourself are a really good looking guy.


What more can you even ask for? You're blessed with it all.

Basically you have everything going for you. You have wealth...Basically you have everything that everyone wishes for. Then why in God's name do you go and commit a murder so gruesome that at the age of 25 you get life imprisonment with no chance of parole.


So this case has been ongoing for 2 years now and just yesterday a verdict was reached. Hernandez pleaded 'not guilty' for the murder, but the verdict indicated something else. In addition, he's being charged on additional charges too related to other events. Pretty much, in short his life is over. Why why why? Why would you do this? He had an entire career in front of him. He wasn't just an ordinary player, he was one of the BEST. Why do people kill?


Look at the Indian justice system, that takes many many many many many many years to close a case and then the US justice system that took 2 years.


Why do celebrities go to such an extent? In Bollywood we have actors like Sanjay (who has been proven guilty) and now Salman (who's case is still ongoing). Basically these stars have everything: a family, wealth, a good profession - all the comforts of life. Then why do they go the wrong road? Not only that but justice is served so late that its almost not worth it. Whereas in the US, even though 2 years may seem long, the time frame is much shorter.


I don't know how many of you have followed the Hernandez case, but the victim's mother was such a sweetheart. She said in her statement that she forgives the people behind her son's death and hopes and wishes that through time everyone forgives the killers too. What a pure heart that woman has. After 2 years finally justice has been served. And Hernandez had the guts to word to her 'be strong.' Did he sincerely mean that? Because he killed the man!


It just baffles me that people want to stoop so low. I mean wouldn't you rather die and commit suicide than spend your life in prison without a chance of parole? The guy is only 25 for crying out loud.


Unlike Sanjay, who seems to be getting all the comforts in jail, that is not the case here (well most of the time anyways). If you commit a crime, you should rightfully be punished. Then who cares if you're a well known celeb or not. But India tends to drag cases to the maximum. How long has the Salman case been going on for now? Or even the Saif/Hum Saath Saath Hai case? Come on man, HSSH released way back in the 1990s. We're in 2015.


What are your thoughts? Any thoughts? My ultimate question is why, when you have everything going positive for you, do you head the wrong path? Imagine a one or two year old kid growing up to learn that his/her father was a murderer? 🤢 💔

No country is perfect but india is far behind the U.S. when it comes to justice, you are blind/bias to even argue that, that's all I have to say! since around here criticizing india's justice system means you hate india, the logic 😆

ya sure US justice system may have far efficient system compared to Indian justice system 😊 . So India needs to work on that and that is one of the big challenges.

Generally, high profile cases drag on and on b/c of the money involved. That's the universal truth across all justice systems in every country.
In most developed countries where there's a big gap between the richest 1% and the poorest...the poor get bad representation or none and end up on the downside of advantage.

As for the Indian system, I don't follow it much...but it's guilty till proven inncoent right? Whereas the US system s typically innocent till proven guilty b/c there was this big argument back in the back that we rather set free 100 guilty people than put one innocent person behind bars.

But like I said, I have no clue on that.

Even here in the US many innocent people end up pleading guilty for crimes they haven't committed because they cant afford good lawyers and end up settling for plea bargains but yes I feel it is somewhat better here in the US than India. But the US judicial system is in no way perfect either.

Comparing Aaron to Salman and Sanjay?

First of all, Aaron committed a 1st Degree Murder as well as possessed unlawful possession of firearm and ammunution.

1st degree murder leads to lifetime punishment, by hook or by crook.

Complicated cases are those that are tagged as Death by Negligence a.k.a 2nd Degree Murder. Sunjay didn't kill anybody and Salman didn't intended either.

Please don't compare different cases and their processing times. I do agree that these cases (salman sanjay) could have been processed faster but nevertheless, Aarons case dragged for 2 years when he should have been given this punishment 2 years ago. He murdered. Salman didn't murder neither did Sanjay.


Also, Aaron still says "Court got it wrong, I didn't do it" -- Is he also a disgusting coward like Salman? 😆 Lol.

BTW - comfort cells are provided all over the world. You have to pay $$$ . I 've heard some places in USA like Cali, offers them at around 300 bucks a day😃

@ Cutiepie Rani, I don't know if there is any one solid answer for why one commits a crime regardless of their social and financial status. Why does a middle class man or a poor man commit a crime? After all isn't a poor house better than jail?

No judicial system if perfect. American justice system has it's own issues. But overall it seems like in terms of speedy trial at least American court cases move faster compared to Indian court cases.


@ ibelieveinpink, I remember hearing the saying "better 100 guilty people go free than one innocent person go to jail" first years ago when OJ Simpson was found not guilty, then again recently when Casey Anthony was found not guilty. I suppose it's a correct stance, but then shouldn't we work on a system that makes sure 100 guilty not go free?


@ grumpydwarf, are you sure about the statistics on this? Because what I have read is that over 90 percent of cases get pleaded out, they never go to trial. But not all of those are innocent defendants. Actually percentage of innocents pleading guilty is around 13 percent. That's still pretty high, and embarrassing for the legal system actually.

Im pretty sure I read a lot of innocent people plead guilty. I might have misread the statistics.

Thank you to those that posted their views without any biasness.


This post isn't about who committed the more punishable crime. Everyone knows that Hernandez has been charged with murder. And though 2 years may seem long, it's still a much shorter period than India. How long did the Jessica case in india go for? (I'm talking about the case that the movie No One Killed Jessica talks about)? A lot more than 2 years I believe.


About Salman, whom you seem to be defending. Yeah, he didn't kill anyone on purpose, but if proven guilty he killed nonetheless. He would have been a much better man if he stayed at the crime scene when it happened. But choosing to run away leaving a victim dying is as close to murder as possible despite not actually have 'murdered.'


This post is about getting justice in due time. Imagine the family ... What they must be going through mentally and emotionally. If not anyone else, think about the victim's family.


Sure, these days $$$ does wonders. But you're still serving your punishment. Hernandez has no chance of parole, unlike Sanjay I believe who's been out of jail for a short period before going back.



Btw on another note: ironic that Hernandez will be in a jail cell about 2-3 miles from the stadium he used to play in when a Patriot? And ironic he played for the 'Patriots' depiste being far away from a 'Patriot' than possible? Shame on people like him. :-/
