I am writing after a long time on suggestion by someone to express my views on Why I am against any adoption track? Please bear in mind that this is not any negative or bashing post but just putting forth my views. Ever since Mishti track started there have been lot of fears and discussions or debates on adoption track. Everyone had the fear that she will be adopted. And with her picture floating in the social media sites, it came back again. Please note this is no bashing but putting forth my views.
Firstly any adoption track is not logical track for the simple reason that Mishti's father is still alive. That is the biological father. And if she needs protection from the father against the abuse, District Child Protection Unit decides on it after hearing it. And if she needs protection as per the latest Juvenile Act 2015 she can be placed in an institution or foster care(temporarily). Foster care is again in the process of evolution in India and there is no program as such which has started yet in large scale. It is last year that Government is working on drafting it and implementing it, but Foster care is very temporary.
For Mishti to be adopted, Vidyut has to surrender all the rights on her. He will be given 2 months of grace period and in the court/District Protection Unit/District Working Committee/District Magistrate he has to sign the final surrender deed. I know cases where father who had murdered his wife, since he did not sign off the surrender deed, he could get the children sent back to his family. No one can do anything. For a child to be legally adopted, one needs No objection certificate which says she is legally free for adoption. Even for abandoned children, full attempts are made to search for the parents including placing ads in daily newspapers, and police investigating into it. Only when there is no hope the matter is placed before the District Protection Unit/District Working Committee/District Magistrate to get no objection certificate
Secondly why this adoption track is not logical, because Neil and Avni according to rules laid by Ministry of Women and Child Welfare and CARA(Central Adoption Resources Agency) run by Government, are not eligible for adoption. Neil and Avni should have at least 2 years of stable marriage which they don't have. And if we look at other hypothetical scenarios like Khannas or Neela Maa stepping forward, they can't as well since maximum age of parents for 5 year old should be 50 years and they will be beyond that.
Adoption is not a easy thing, there is lot of preparation, ground work that goes. Home studies are conducted, then again court/District Protection Unit/District Working Committee/District Magistrate studies or scrutinizes your fit or eligibility before legalizing the adoption.I understand there are lot of misrepresentations in the shows and I have seen it myself wherein in one show they showed biological parents landing up at adoptive parents house after adoption, which is not possible. Once court passes the order, biological parents cease to have rights and they need to approach the District Working Committee and court with valid reasons.
But I am raising this and objecting to this because shows are misleading people. So much so people are not even aware that CARA has become central function for adoption including Family adoptions or Step child adoptions. They think it is an easy process and get frustrated by long waiting periods and administration process. This leads them to resort to illegal routes of adoption where they pay money to hacks. They don't realize that these hacks actually steal the children, buy children from parents under duress to complete others' family. The Government, activists which include Adult Adoptees, parents are fighting against these irregularities. This is fact wherein recently 16 children were rescued in illegal adoption racket, of which some of the children had lot of trauma as they underwent separation twice. This racket came into light when one of the child was stolen from the mother in the temple.
Creative liberties are taken, yes true, but it is our collective responsibility as well that we don't show wrong messages to glorify something. I mean to glorify adoption we can't show wrong message. Sorry long post
