It is an established fact that Rukkaiyya sultans ill intent and hatred towards rani Jodha has been escalating. Her attitude wrt to jodha begum began from dismissal, to contempt, to hatred,to immense hatred.

And accordingly her crimes have been becoming more serious, from public insults, to hiding truth that led to growing tension between jodha and Jalal (MB and Aadham issue), to using Benazir to try to further the distance between jodha and Jalal (not to mention the humiliation during this phase), to hiding truth about presence of a man in harem ( which could have endangered Jalal and other harem members), to trying to drug Jalal so that he is unable to spend time with jodha on their marriage anniversary,faking pregancy (which caused deep hurt to Jalal and his family), to finally deciding to a take a baby of rani Jodha to avenge her taking Jalal from her. I believe defence can concur that these acts were committed by accused with a premeditated attempt to cause havoc in rani Jodha's life

If the defence is using sanctity of a polygamous marriage to justify Rukkaiya sultans significance in Jalal's life, they should revisit her claims of commitment towars Jalal's well being - she used Atifa to draw jodha and Jalal apart, this could have backfired if Jalal's love for jodha was on shaky grounds, and would have lead Jalal committing zeenakari and his subsequent impeachment. Since a true wife uses her power to give sane advice to her husband, and Rukkaiyya in this condition deliberately did the opposite, we will refute her claims of being Jalal's well wisher, and thus do not think she is worthy of respect and position that being Jalal's first wife allows her.

To quote Wikipedia "Justifications for punishment include retribution, deterrence, rehabilitation, and incapacitation. The last could include such measures as isolation, in order to prevent the wrongdoer's having contact with potential victims"

An important reason for giving punishment is to prevent future wrong doings by a person. Since as of now Rukkaiyya sultan shows no remorse for her actions, And since her viciousness and seriousness of crimes is increasing, it is likely that if unchecked her future crimes may cause more severe and permanent damage to the victims and their offsprings. Given this can the defence establish beyond doubt that she will not engage in any further and more vicious crimes against the victim?

If such an assurance of Rukkaiyya sultans change of heart cannot be produced,we request the court to do justice and rule in favour of victim. Thank you

Ruku gets worried thinking that Jalal will think that she has not been a good mother and use the reverse farmaan to get the baby from her (Here is where the reverse farmaan becomes significant). She intends to exchange the kids so that she doesn't lose the child by reverse farman,(don't ask me how she manages to swap...if Shehnaaz can poison a crown, Ruku can also swap), but Ruku doesn't know that the child is seriously ill or dying. (It has to be so as,if she did it knowing that the child is about to die and then swapped then the fault becomes unforgivable even after 6 yrs).She may intent to re-swap the child after Hussein gets well.

She is shocked when the child is dead (Hence the camera zooms at the shocked face of hers) and now hides the truth, else Hassan will be returned to Jodha and she will be left babyless. She has become paranoid fearing exposure and wants the baby in her sight always. This also explains that Hussein died a week before Hassan.

Now when Putana poisons the child when with Jodha, and he vomits, a little first and quite seriously the next time, and then continuously like the other baby, the Hakima saahiba says that he is showing symptoms like Hussein did at first and Hassan later...it might ring a bell in Jalal. Salima may convey her fears of Zeenat and Z and Q may be caught...After they are caught and punished, Jalal may confront Ruqaiyya and accuse her for her action and ensuing silence. She might use her other farman to save herself from public exposure, but their rift on the issue may take a lot of time to heal.

Then comes the leap and nafarman Salim wooing Anarkali.

I think this fits and covers all angles, else we may well get a babaji ka thullu like the teda jalal in the mirchi war.
