Friends , I am confused. As per law in my country( Sri lanka - India also based on same English law as per my knowledge ) a man can legali married for one woman. When the first marriage is there no matter he marries number of women. Second marriage automatically cancelled as per law. No need to get divorce .

Why this Adithya and Malini getting divorce by legali. Its already illegal.

Per indian law, you cannot have two wives.

here, though Aditya married Imlie first, he hasn't registered the marriage, which essentially means he doesn't have a marriage certificate.

His wedding with Malini is recorded and with both of them being educated and smitten, I'd assume it's registered and hence legal.

Actually speaking Malini has more rights than Imlie. which is why Malini threatened to go to court for adultery charges. she stopped when Aditya told her that Imlie is his first wife, which is how he sees it. so for Malini there is no point in being in a relationship where she is second fiddle. hence the divorce to dissolve it.

Registration is not mandatory in India. A non-registration doesn't make the marriage invalid. Though Adilie got married by force but thier marriage is still valid and legal unless avoided by either parties which didn't happen so yes, Adini marriage is invalid Amal's there is no need of a divorce to dissolve it. She can simply walk away

Then Malani is first wife. Imli has no rights. first Legal marriage is marriage.

I have a different opinion about adultery in this case, because it's not.

But without getting into that, Malini can press adultery charges against Aditya, but she can't get Aditya behind bars.

Even if she files the case, she will get only Divorce. So when it's happening mutually, there is no point of dragging it into court.

I completely agree with this.

In india majority of marriages are unregistered, but it doesn't wife has any less right, since it wasn't annulled on the grounds of non consent.

Malini is his wife in eyes of society, but Imlie is legal and first wife. I don't feel there is requirement for divorce, but for Malini's and Aditya's image, it's better to go through legal procedure.

Malini CAN get Aditya behind the bars as he concealed the fact of his first marriage from her while marrying her which is an offence under Indian Penal Code

I am hearing for the very first time that most marriages are not registered in India. Maybe few decades ago no one bothered but it's not the case these days. Irrespective of caste or creed every couple needs to have valid marriage certificate. No court or financial institution will accept any claim by either parties if there no legal proof.

The family court in India has a particular format for registering and issuing certificates and we abide by it. In villages, the panchyat board takes care of the formalities.

Adilie got married at gun point, I think they got married twice and the second one was in front of the Sarpanch. The Panchyat can provide a back dated certificate which can make Adini's marriage null and void.

Yes Malini can file a case against Aditya for not revealing his marital status and withholding information before getting married.
