You know...this is exactly what came to my mind the other day i was studying IPC...and this particular provision. And I instatnly thought of Geet. Was thinking of posting the same. But felt a little awkward in doing so. Did'n know how people would react to it.

There is a plethora of case laws in this regard, Supreme court judgments, etc which I can produce on this contention. It is actually a very persistent problem in India and a roadblock in the empowerment of women. Many women do not come forward thinking they are going against the society rules or that they are breaking the sanctity of marriage. What they don't realize is the man did not have the right to even touch her in the first place.

I am a law graduate...aspiring to be a civil servant in our country. But cases like these and the helplessness that surrounds you makes me want to give up at times.

I've been thinking about this for a long time, but I wasn't sure if was appropriate to bring up this aspect on the forum. I think you bring up an absolutely valid point. According to the law, Geet WAS raped. I think most people would be hesitant to accept that because their definition of 'rape' is very limited. It is not limited to just "consent/non-consent"...Here in the U.S., I think only a handful states recognize "Rape by Deception" as a crime.
