Noida police par yakeen karna khatre se khaali nahi.

But still I think they would not cook stories in this case because there is so much media attention. What I find hard to believe is Arushi - Hemraj "sambandh" as described by them, the police didn't clearly spell out what kind of "sambandh". As writely pointed out by many if they had "sambandh" and Dr.Rajesh knew about it then why on earth did not he sack him or send Arushi to somewhere else, he could have done so many things.

Hmmm..its getting murkier.

All the Indian news channels on Dish Network have been broadcasting interviews with Dr. Anita Durani, her husband and their extended family. Watching it I couldn't help but feel sorry for them. Although totally shell shocked they were very upfront, forthcoming, sincere and addressed all the questions posed to them. I am now convinced beyond a shadow of doubt that the cops in a desperate attempt to shift the focus from their own blunders, ineptness and incompetence to solve Aarushi and Hemraj murders have concocted the whole "extra marital affair" angle as a motive for the crime.

My advice to this family would be to get the best legal counsel that money can buy, and fight back with everything they have. After all, this case has not only destroyed the reputations of this family but their livelihood as well. Once the ludicrous criminal trial is done with, they should sue the city of Noida in a Civil Court and hold it libel for defamation and for subjecting them to public contempt without just cause.

I am not sure why Dr. Mrs. Nupur Talwar is maintaining total silence after all this time. Maybe that is what her legal counsel has advised her. However the longer she keeps her distance and stays quiet, the speculation in the media and the court of public opinion is going to work overtime in destroying her credibility. The blundering cops are also going to find some cockeyed logic to misconstrue her silence as admission of guilt. This is a horrible conundrum to be caught in. She, with the help of her legal counsel should release a statement soon, or this whole thing is going to become a horrible avalanche that will be hard to stop.

Dr Nupur Talwar has just spoken, she says her husband is innocent. She said that her husband is a very generous soul and she cannot imagine even in her wildest dreams that he could kill their only daughter. She said that her husband loved their daughter like anything.

Today is Arushi's birthday, they had planned a big party ( a fact confirmed by her friends on zeenews). Dr Rajesh was also planning a holiday with wife and daughter for June 15th.


She also said that Dr Praful Durrani ( Anita's husband) is their family doctor, they were like an extended family, Arushi and their daughter were studying in the same school and class.

She also denied that her husband could have an extramarital affair and that too with Dr Anita Durrani.

Killed, and slandered in death

Fatally assaulted in life, and slandered in death. Fourteen-year-old Aarushi Talwar, the bright and popular student of DPS Noida, was allegedly caught in an "objectionable, not compromising" position with domestic help Hemraj — a situation that supposedly drove her father, Dr Rajesh Talwar, into killing both.

Amidst the garbled wordplay and assumptions (there is no evidence to support the allegations) lies a deeper issue. That of justifying a heinous crime — whether it's cops or lawyers — by casting aspersions on the character of a girl who can no longer defend herself. Says an outraged Madhu Kishwar, professor at the Centre for the Study of Developing Societies (CSDS), "If the defamation laws were strong in the country, these people (the cops) would've been arrested." She also felt that a child, in the absence of a nurturing environment at home, could turn to the domestic help for familial warmth and attention.

Sudha Sundararaman, General Secretary at the All India Democratic Women's Association, believes the issue at stake is to find out the exact sequence of events on that fateful night. "The fact that Aarushi was in a relationship with Hemraj is merely speculative and cannot soften one's stance on the crime, whether committed in a fit of moral outrage or otherwise."

The slow buildup of the wayward character of the 14-year-old has been widely condemned by women's groups. Says Nandini Rao, joint co-ordinator at JAGORI, "The most vulnerable place to hit a girl is at her character." She adds that the details of Aarushi's friendship with a boy in her class (she made 688 calls to him) and her obvious popularity are an attempt "to make us believe that she deserved it. And by using terms like honour killing to describe cold-blooded murder, one is increasingly left feeling that she may have done something to justify it."

Kiran Walia, who heads the women and child committee of Delhi Assembly, stresses the importance of raising public consciousness. "If the public believes the allegations being tossed around, they won't come out and condemn the crime."

Women lawyers, too, came out strongly against Aarushi's character assassination. "It's preposterous! It is very unlikely that there would be an affair between the girl and the servant. This is a typical situation when a girl child or a woman is involved. Crimes of passion happen instantly, not with the surgical precision and with cold calculation as Rajesh Talwar allegedly did," says senior advocate Pinky Anand. She says that if indeed something like the police version happened, then the girl would be a victim and therefore saw no reason why the father would kill her too. "It doesn't fit into the sequence of things. If indeed the father is the killer, he must have consulted some lawyer and given such a statement because it is intended to make it look like a case of culpable homicide not amounting to murder," she added. However, Aarushi's mother, Dr Nupur Talwar, has dismissed the police story, saying she completely trusted Hemraj.

Noted criminal lawyer Kamini Jaiswal also voiced her outrage, calling the turn of events "disgusting." Adding that the case still had to be proved in a court of law for Rajesh Talwar to emerge as Aarushi's killer, Jaiswal saw attempts at erecting a legal defence in maligning the girl after her death. "The father, provided charges stick to him court, has to show it was a case of grave and sudden provocation. But facts don't support him. He has organized everything. If it was sudden he would have killed the girl and the servant instantly. Instead he waited and took his time planning and used a surgical knife."

Drawing an interesting parallel with the Jessica Lall case, advocate Shilpi Jain said this is a common strategy adopted by the accused. "Even in Jessica's case, the murderers tried to portray her as a woman of questionable character, but it didn't help their case. These aspects come to light during cross-examination. Legally there is no strong evidence against Rajesh Talwar because no recovery of weapons has been made yet. Also, the police can't show any chain of evidence, leave alone an unbroken one."

Whatever the legal loopholes the police may have to plug, the lawyers were unanimous that any decision by the court will have to be closely hewed to the facts of the case.

The newspapers are filled with articles and editorials on this case, and I am relieved that the thinking population of India is not going to let the inept police of Noida and U.P. railraod them. This article turns the knife in the one's heart and really drives the point home. I salute, support and stand by all the women, and children who have taken a stand against this injustice.

Mayawati wake up and for once do right by someone other than yourself!!!! Do Aarushi and Hemraj who have already paid with their lives really deserve this from your incompetent, inept and illogical police force? Don't add insult to the injury that has already been inflicted on Drs Rajesh and Nupur Talwar.

The attempt to malign her and raise doubts on her character is as low as it can get. My folks back home know one of her classmates quite well. Per Aarushi's classmate, all these stories floating around about her alleged affairs can't be true. They just can't be true.

Gauriji it appears that these young kids have shown more maturity, compassion and an objective outlook as opposed to the Noida and U.P. police. I understand that these youngsters have also arranged a candle light vigil at the Jantar Muntar today to celebrate what would have been Aarushi's birthday and to show solidarity with the Talwar Family.

I am truly impressed. I hope "the powers that be in U.P." sit up and take notice. It is time that the Noida police be relieved of investigating this case. It is also time that some level headed and objective police officials in U.P. review the "evidence."

I believe the friends and acquaintainces of the couple are finding it hard to believe that the couple had anything to do with the murder...if that indeed is the case I cannot even begin to imagine the plight of the mother who lost her only child and now has her innocent husband in jail...

people say that Hemraj had confided in some of his friends that his life was in danger...could it be danger from outside and not his employer...has the angle even been explored fully?

but if the parents had even an iota of involvement in the whole thing they deserve the gravest punishment!

Somewhere during the course of this past week it was the Noida Police who had stated that they had learned from Hemraj friends that he was fearful for his life. The same police force had also stated that Hemraj had consumed alcohol on the night prior to the murders. In addition the police also claimed that Dr. Nupur Talwar had tampered with the evidence when she asked her driver to dump the blood soaked mattress from Aarushi's room on the neighbor's side of the terrace.

However now it appears that all these statements are highly suspect, questionable, and amount to mere hearsay. None of Hemraj friends have confirmed the "threat to his life" statement that he had allegedly made to them, and which they had supposedly reported to the Noida Police. The autopsy report found no blood alcohol in Hemraj body. The driver has gone on record to state that he moved the mattress to the terrace at the behest of Dr. Talwar's older brother and not Nupur Talwar as the police had stated. He added that the Noida Police had given the go ahead to clean the bedroom since the body had already been sent to the crime lab for the autopsy. Moreover the driver also said that he had to use the neighbor's door to access the terrace since the Talwar's access door was locked and the only key was with the A.W.O.L. Hemraj.

I have yet to see one shred of evidence that will stick. There are so many inconsistencies and pure blunders in the Noida and the U.P. Police investigation, that, you don't need a "dream team" of attorneys like O.J. Simpson had, to poke giant holes in the prosecution's case and conclusively prove that the parents had nothing to do with the crimes.

Going forward the entire Noida and the U.P. Police should only direct traffic at intersections, that too.... if they can do it without screwing up.
