The above judgement came recently regarding abetment to suicide. She will get away with it as well, probably as innocent. It say's the following

" Abetment’ is defined in Section 107 of the Indian Penal Code (IPC). Its ingredients consist of instigating a person or to intentionally aid a person to do or not do something. Similarly, the crime of ‘abetment of suicide’ under Section 306 of the IPC involves instigating or actively aiding a person to take his own life. Abetting a person to commit suicide should be intentional, deliberate and calculated, it said."

“In order to prove mens rea, there has to be something on record to establish or show that the appellant herein had a guilty mind and in furtherance of that state of mind, abetted the suicide of the deceased. The ingredient of mens rea cannot be assumed to be ostensibly present but has to be visible and conspicuous”, Justice Roy, who authored the judgment, said.

If the above was easily available Rhea would have been in jail by this time. It is extremely difficult to prove abetment without solid visible proof.

I didn’t say C-list just to degrade Rhea but more to point out that she is hardly someone very influential or powerful who BJP would set out to target and frame, and the Chakrabortys clearly have no political links, because we would know by now if they did 🤷🏽‍♀️

I meant to say that if she has been caught then it is because she is a legitimate suspect with quite a lot of evidence stacked against her, not for any other reason.

And yeah I agree, tomorrow if she is found guilty and sentenced also these people will say she is innocent, framed, trapped etc...

And if Rhea is really innocent, then why are Showik, Samuel, Zaed, Basit, Gaurav etc also in jail? Why would they jail all these people without “proper evidence”? What could they possibly gain from it?

And will BJP, CBI and NCB not suffer a huge loss of face if EVERY SINGLE ONE of these individuals is actually completely innocent (as many on this forum claim)??

I don’t think they would do this so openly, showing public all the evidence through news channels, etc if this is all just for elections 🤷🏽‍♀️

I think you are being very naive. This is a govt that arrests small student activists because it benefits them. "Largest political party" or not, they have to do everything in their might to keep their power. That's why they will resort to anything.

And CBI, NCB, ED, all these agencies are under the govt. They can be misused as per their whims and fancies. Just today there was a CBI raid on an opposition party leader in Karnataka, based on information passed on by BJP. Why? There are no corrupt people in BJP? Why no raids on them? Because that's how power works.

Yes, BJP, CBI and NCB will not suffer a loss if everyone of these is innocent. Why? Because they have nothing to lose! They are only being kept in custody to keep masses happy and to give an impression that some serious investigation is happening, when in fact, there is none.

The laughable arguments by NCB's lawyer in courts proves my point.

Either you're new to politics, or you're really under-estimating BJP tactics.

Unfortunately this site is very disconnected from reality... some people saying scarily harsh things about the departed man and his recently bereaved family 😔

And if not compassion then I wish the Rhea fans gave importance to facts, evidence and common sense!

But for whatever it’s worth I feel at least some people need to stay on here to present the facts as well as support the wronged family, however indirectly ✊🏽
