Defence argues against claim that film defames

In a civil suit being heard at the Pune sessions court against the controversial film Padmavati, the defence on Friday submitted that the movie has not yet been approved by the national Censor Board as required under the Cinematograph Act of 1952, hence rendering the suit premature and unable to disclose any cause for action.

A group of three lawyers had on November 17 filed a civil suit against film director Sanjay Leela Bhansali and the lead actors of the movie, saying the oeuvre defames historical characters like Raja Rawal Ratan Singh, the king of Mewar, and his queen Rani Padmini, as portrayed by Shahid Kapoor and Deepika Padukone, respectively. While claiming that the movie is defamatory, the trio also said that its release could hurt public sentiment and cause a major law and order situation.

On Friday, senior lawyer P Narayan appearing on behalf of Bhansali and the actors objected to the suit and its maintainability, filing an application under Order 7, Rule 11 of the Civil Procedure Code. He further filed an application to recall an order passed by the court earlier on the same day, issuing summons, submitting that even the Supreme Court has observed that when a matter is pending for the grant of certification, it is a violation of the rule of law if responsible people in power or public offices comment on the issue of certification, pending consideration before the statutory authority.

Narayan also submitted an SC judgment (Nachiketa Walhekar v/s the Central Board of Film Certification), along with another judgment in which the apex court held that "a film/ drama/ novel/ book is a creation of art, and the artist has his freedom to express him or herself in a manner not prohibited in law if such prohibitions are not read by the implication to crucify the rights of an expressive mind"; the lawyer further prayed that the plaintiffs be rejected with a heavy cost.

Meanwhile, advocates Sudip Kenjalkar and Smita Padole argued on behalf of the trio that a detailed order has been passed by the court already, nullifying the grounds mentioned by the defendants through their latest application. Kenjalkar also moved that Narayan's application be disposed of.

The next hearing in this case will be held on January 15.

Meanwhile, Padmavati is finally to be viewed by the Central Board Of Film Certification (CBFC) this week.

According to sources from the CBFC, the producers, Viacom 18 Motion Pictures, have submitted the revised version of the application on November 28.

"The new application is very consciously worded in legalese, and the CBFC is trying to decode the various levels of claims and disclaims in the application about the historic authenticity of the film. This is taking time. But the film will be viewed by the board's Examining Committee in the coming week, and we will have to organise a panel of historians to examine the content, a source from the CBFC says.

Violence is not the way: Aamir on 'Padmavati'

Everyone has a right to protest but violence is not the way, says Bollywood star Aamir Khan, terming the threats to Deepika Padukone and Sanjay Leela Bhansali over their film "Padmavati" as "most unfortunate".


The actor said he would not like to "comment directly" on the raging controversy over "Padmavati" but violence is never a solution.


"I feel that everybody has a right to protest. But I think in a democracy and in a country where we believe in the rule of law, I don't think anyone should be threatening people with violence. That is most unfortunate," Aamir told PTI in an exclusive interview.

The film's release date has been deferred following protests from various Rajput groups and political leaders who have accused Bhansali of distorting history.

Director Bhansali had said the film is based on the 16th century epic poem "Padmavat".

The row took an ugly turn with death threats to Deepika and Bhansali.

"No matter what walk of life you are in, whether you are a film person or a non-film person -- you could be a doctor, an engineer, a government servant -- but to be threatened physically is most unfortunate.

"I don't believe in that philosophy. It reflects badly on us when things like this happen," Aamir said.

According to the actor, such threats are not restricted to film people.

"As an Indian, it makes me sad. It is not just restricted to a film personality, it could be anyone. The rule of law should be upheld and no one should be above the law and no one should take violence in their hands," he added.

Most Bollywood celebrities have kept quiet about the "Padmavati" row. Salman Khan, Shabana Azmi and Javed Akhtar and directors Anurag Kashyap, Hansal Mehta and Anand L Rai are amongst the few people who have spoken their mind.

Also guys as per news reports from Gujarat KARNI SENA had given 24 hour ultimatum to PM Modi to ban Padmavati in India or else they wont vote for BJP.
The ultimatum was given on Wednesday since no action was taken.

Sena declared yesterday evening that they wont vote for BJP tmroe.

Looks like the whole padmavati controversy did not work for BJP
