Every accused is entitled to a fair trial, no matter how heinous the crime. Besides, the lawyer didn't create this loophole; it's already there in the system and he's making use of it to do his job. It's the court that should take a firm stand on this and set a good precedent.
One of them, Ram singh also wanted to be tried outside of Delhi for an 'impartial trial'. Next thing we know...all 6 of them will allege being 'helpless' witnesses as the young girl removed out her own intestine and inflicted injuries on self. And then TOI would come up with a new headline along the lines of 'No one killed Jessica'. And guess what the 6 of them would do to celebrate being let off lightly?
This is where the court needs to be very clear...and need to establish beyond a shadow of a doubt that the accused committed the crime. And punish all 6 severely solely on the nature of crime committed. Both SC and HC needs to uphold the harsh sentence without letting the criminals delay the process anymore.
Before we ask ourselves why are sexual assault crimes on the rise, we need to check why is it that our courts set such bad precedence even in cases where all facts and evidence exist against the guilty.
